Can any action be taken against me still for stealing that happened 7 years ago?

Answered 10 years and 5 months ago by David Hohvannes Akulian (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
That depends on how the theft was accomplished. If there was fraud involved, the statute of limitations (the period of time during which the prosecution can file a case against you) starts once the fraud is discovered. If there was no fraud, the statute may have expired and you may be in the clear. However, you MUST talk with an attorney about this. Do not rely solely on questions to an internet forum. Good luck.... Read More

Answered 10 years and 7 months ago by David Hohvannes Akulian (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
That depends whether you were arrested and given a notice to appear in court or not. An arrest will appear on a person's record once they get arrested. But if the police are not involved, there will be no arrest on the individual's record.

Answered 10 years and 8 months ago by David Hohvannes Akulian (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
Hard to say without knowing more. More importantly, did you have insurance to cover loss? That should put you back in the position you were in before the theft. Good luck.

How long does the grand jury have to indict you?

Answered 11 years and 6 months ago by David Hohvannes Akulian (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
A person can be indicted up until the end of the statute of limitations. However depending on the kind of case indictment usually occurs between 3 and 10 months from the time of arrest. Much of the time, the prosecutor tries to drag the case out so people commit more crimes and potentially do things which could make their case worse.... Read More

What will happen if I was charged with marijuana possession charge?

Answered 12 years and 2 months ago by David Hohvannes Akulian (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
This is a very good question. Times are changing and so are the laws. As I understand it, the District of Columbia City Council is working on a bill which will penalize less than an ounce of marijuana with a $25 fine. Some judges I appear in front of in DC are listening to that intent prior to the passage of the bill. Other judges are not. Currently the penalty under the statute is up to 180 days in jail, up to a $1000 fine, and from $50 to $250 in court costs (VVC). However, before sentencing, there are always potential defenses including legality of the search, or other potential defenses. Additionally, before a person is convicted of possession of marijuana, there are multiple diversion options to prevent ever receiving a conviction, and then more (and sometimes better) post conviction remedies such as 904.01(e) probation. Good luck and be sure to speak with a lawyer about your case.... Read More
