It may depend on his driving record otehrwise. You could call the prosecutor's office and see if they will tell you if there is a standard deal or not. Also, some tickets allow mailing in the fine and that reduces the points if done within 20 days - look at the back otf the ticket.

Will or can a judge find out if you were texting by searching phone records if you are involved in an accident.

If they did not take your phone at the time they issued the ticket, then it is VERY unlikley that they will get a warrant to serve on the compnay that provides your phone service (and they woudl have to know what company that was) to get phone records. I cannot imagine them doing that in a situation like the one you described.... Read More

I know of no way that a car insurer can "suspend" someone's license. A car insurer can decline to insure a person and if they are required to provide proof of insurance to keep their license, then the DMV could suspend their license until they provide proof of insurance. Can I get proff of my traffic violation from the cameras above the street lights?

My experience is that many traffic "camers" at stop lights do not record, rather they are there to detect traffic and modify the signal sequence as needed. But some are recording devices, especially in Denver. But they do not retain the recording for long and it is fairly quickly recorded over, so you woudl need to seek to preserve it quickly.  However, if you agree that you stopped past the stop bar at a stop light, I am not sure how the camera helps you if it exists. It might be better to look into whether the officer had sufficient "consent" to search your car.  A lawyer who reviews the police reports and hears your version can he;p you with that. ... Read More

Most courts will allow for a payment plan to pay off fines and court costs.  Some will even allow a person to do community service work in place of paying money. I do not know if Manitou Springs does that ro not however.

This is a very fact specific question, but a persons home is protected to a large extent from illegal intrusion by police officers.  But, it is possible the police actions were okay depending on the very specific facts of what occured, what they knew, etc. when they entered.

It would be very unlikely - normally a person cannot get a Colorado driver's license isf their license is revoked in any otehr state. There is a National Driver's Registry that Colorado woudl check before issuing a licnese.

I think to answer this a lawyer is going to mneed to analyze your driving record and see what is going on. It would not be possible to answer this question from the information currently provided. That said, it seems like the place this has to be straightened out is in Florida - where they say you have an outstanding traffic viiolation (but clearly is not you).  I would contact a lawyer in Florida OR contact Florida DMV and see what they require to remove this from YOUR record - i.e. what do they need to believe this outstanding ticket is not YOURS. ... It would be unusual for a judge to agree to reopen a case once it has been taken care of in Court. But you could always ask if it can be done (contact the clerk for the Judge and see if they will get your case back in front of the Judge). I doubt they will, but you could ask.  "Plea Bargains" in a case are normally offered by a prosecutor (not a judge). If there was no prosecutor in your case, then it was a state court traffic infraction and the judges have very limited power to do anything in those cases.
