IS there a way to stop my ex from receiving the economic impact payments for our child?

Answered 5 years and a month ago by Lance Herndon (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Taxation
The short answer is Stimulus is paid to whomever claims the child on the tax return. From the sounds of it you should have claimed the child in 2020, unless there is a divorce decree or other that allows her to claim.

Can my dad come back to the US?

Answered 5 years and 3 months ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
Generally speaking, DHS would not allow a deportee to return to disprove a charge for which he was convicted or pleaded guilty. To DHS, having a disability is not a persuasive reason for coming back to the US, especially with the present emphasis on enforcing the public charge provisions. Assuming you no longer live in Maryland, you question whether a Maryland child support order still applies since your wife's relocation outside of Maryland. That is not against the law, it is the law! Maryland (like most other states) adopted the Uniform Interstate Family Support Act that gives the original state continuing, exclusive jurisdiction to enforce or modify its child support order unless all parties consent to submit the case to another state where at least one of the parties now resides with the child. This discourages parties from relocating to reduce child support. Very technical area of the law - consult an attorney!... Read More

The issuance of a visitor’s visa to the United States after leaving the country is in the discretion of the US consular officer. The length of time that you stayed in the US will be a negative factor in deciding whether to issue the visa. I note that if you are in proceedings before the immigration court, you will find it very difficult to withdraw your asylum case. If your pending asylum case is with USCIS, there is the added risk that the asylum office may issue you a notice to appear before the immigration court instead of only terminating your case. Do I have a civil suit?

Answered 5 years and 4 months ago by attorney Stephen Arnold Black   |   1 Answer
Hello Chad. I'm sorry to hear of the problems that you're having. You are in Maryland according to the geographical location that was selected here. If you do plan to file suit it may be and I emphasize maybe that you may need to retain counsel in the state that the defendant resides because if you file suit, that the Jurisdiction of the court will lie where the defendant resides or where the contract was to be performed. So in what state does the defendant live, and what state was the contract to be performed?... Read More

While you were caring for your parents, you were their guest.  Once they passed, unless there was a written agreement that you could live in the property for one year, you became a tenant at will.  It became the duty of the executor of the estate to evict you and sell the property to pay the estate's debts, dividing the rest according to the Will or, if a Will was not admitted to probate (proving), according to the state's laws of inheritance.... How do I remove a credit card lien against my property?

Answered 5 years and 5 months ago by Joseph Edwards Ashley (Unclaimed Profile)   |   1 Answer
In Maryland, liens such as the one you've discribed are good for 12 years, but can be renewed by the creditor for subsequent 12 year periods.  One way to try to have the debt removed from your credit report would be to dispute the debt (in writting) with all three credit reporting agencies.  If the debt can not be proven, it will be removed from your credit report, but will still show as a lien from a monetary judgment in court records.  The only way a legitimate lein can be released is is you saticfy or negociate settlement of the lien with the lein holder.  If the law firm or the lien holder (citibank) can not prove they are entiriled to the lien, I would try to colaterally attack the lien in some manner if possible.  The lien could also be removed should you be eleigable for a consumer bankruptcy.... Can I be charged with coccaine if I was in the car with someone and they had it in there pocket

Answered 5 years and 5 months ago by Joseph Edwards Ashley (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Technically, you could be charged under the theory of constructiove possesion, although, because the dope was on someone else's person, the State would mostlikely not win.  The sucess of a consructive possesion case depends upon how likely it is that you might be the owner of the drugs, that is, if no one admits to their ownership.  For instance, if there are four of you in the car and the search finds the drugs somewhere in the front of the car, then it is more likely that they belong to the driver of the car or the fornt seat passanger due to the drugs proximity to those passangers.  They also will look to who the owner of the vehcile is if they have no other incidation of which one of the passangers actually possesed the drugs, i.e., stuffed between seats or placed randomly on the fioor.  These cases depend upon the facts of the partiucalr situation.... Preusming you did not sign the second agreement, the first agreement would is the only one that would control and be enforcible.  Even if the company made a mistake. in order for that mistake to affect the terms of the first agreement, both parties (you and they) would have to had made the same mistake. If both parties to an agreement make mistakes regauring matierial (signifianct/important) terms of the agreement, either party can recind (cancell) the contract which is what the employment agreement actually is....
