Can I get a court order to sell a house me and my ex own together

Answered 3 years and a month ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Real Estate
You can go to court to get the house sold. Michigan law allows this. The will probably be given the chance to buy out your share but has to come up with the money to buy you out. You will need legal counsel to make this happen.

If you have not had any issues, Michigan permits you to apply to expunge this from your record. You can try to do it yourself but those represented by counsel usually have a higher success rate.   Good luck to you.

what steps do i take from here

Answered 3 years and a month ago by attorney Gilbert Borman   |   1 Answer
Whether you have insurance or not, any damage to the property can be recovered from the driver's insurance policy or from the driver personally. In terms of the repairs to the property, your landlord may have insurance from this but they also have a claim against the driver. However, since you did not have renter's insurance, your landlord can look to you for damages on this incident. By not having insurance, you technically breached the lease. Depending on how much damage there is and the insurance of the car involved, you would be wise to find a lawyer to represent you on this. This is not a simple matter. You would be wise to get estimates on the repairs and you need to notify the landlord and the insurance company for the driver of any claim you have. The sooner the better. Good luck.... Read More

I am not sure what 217 10000 means, but the usual advice in situations like yours would be to apply for a student visa directly at the American consulate or embassy, and explain your refusal under ESTA at the visa interview. Please note that you cannot make an application for change of status from ESTA to student.  Due to the limitations of the Lawyers.com Forums, Alan Lee & Arthur Lee, Esqs.’ (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can I be done with my land contract

Answered 3 years and a month ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Real Estate
Technically, when you did not pay per the Land Contract Agreement, you were in Default. The Agreement determines what the remedies are on the sale. You might be well served getting legal help- interpreting the agreement and seeing if the seller breached the agreement first. If you are confident enough, negotiate, send a counter-proposal to the seller say for one year with a $5000 balloon.  Sometimes, when it comes from a lawyer it sounds better.... Read More

Looks like you are being sued. Here's the issue, if you keep ducking service, the other side gets an order for alternate service and serves you that way. The nastier sort add the costs of the motion and alternate service to the damages. There can be very good reasons to avoid service but youcan only avoid for so long.  ... Read More

It looks like the publisher stole your idea:  you need to prove the submission and their interest this is a very tough case to win as a budding author myself looking to get published, I definitely understand the anger and pain you must feel regarding this. feel free to be in touch, if I can help, I will.... Not knowing for sure what kind of attorney that I need to hire

Answered 3 years and a month ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Libel, Slander and Defamation
You are going to need a very solid litigator for this. the first things anyone looking at this case is going to ask is what are you damages and is the other side collectible. sadly if there are not significant damages and the other side is not collectible, no one will want the case.

DAs are supposed to turn over evidence to your counsel as soon after they find it. They have a duty to disclose, a failure to disclose is misconduct. Given they found the gun in the car and you at some point were in the car, that is still a big problem for you. Best of luck.

As you describe things, you are going to need a criminal lawyer to address the domestic issue. it is not clear if this is one incedent or more. the court will appoint an attorney for you if you cannot afford one.

Anything related to your birth records will have to be done in your county of birth; it cannot be done anywhere else because that is where you were born and that county and no other county in the US controls that record. As for Zoom, it is often available, I would call the clerk of the court in Oregon to see if you need to be personally present. If they say you have to be present, then you have to be there. Sorry if that is not convenient. Good luck.... Read More

Can an insurance refuse to cover pipes?

Answered 3 years and 2 months ago by attorney Gilbert Borman   |   1 Answer
It depends on the terms of the policy- on one hand, they honored the claim and put your daughter up in a hotel, I do not see why they recognized one part of the claim and not the other. You definitely need to consult an insurance claims attorney.
