If they do not fix it, you can send them written notice that you are putting rent in escrow until they fix the property. Has to be a separate account. If they still don't fix it, you can break the lease and get your deposit back.

You will probably need to sue them. The landlord is probably in breach of the lease if the conditions made the place uninhabitable. Leases contain an implied warranty of habitability. Get My License Back

Answered 3 years and 6 months ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: DUI/DWI
you will need to hire a lawyer specialising in DUI license recovery. if you have complied with the court orders, paid all fines and served any time given, it should be simple but I think it requires a motion to the court.

Do I have a case?

Answered 3 years and 6 months ago by attorney Gilbert Borman   |   1 Answer
Dear Lisa, It is hard for a roof to leak and the owner not know it. You have no real cause of action against the inspector because your damages are limited to the amount you paid them. Proving fraud on the broker is not easy. You definitely need to retain legal counsel to have any hope of recovering damages. Obviously, if it is a repair, that can be somewhat expensive, a new roof is very expensive. I hope this helps. Gilbert Borman... Read More

business issue

Answered 3 years and 6 months ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Business Law
If the goods and the person who took them are in Michigan, you can sue them in district court and take a judgement against them. Collecting from them is the larger issue. In theory you can also sue Amazon. They are collectable but they will fight his very hard.

Can I sue a relative for deformation of character?

Answered 3 years and 6 months ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Libel, Slander and Defamation
Defamation can be hard to prove in court. You probably need counsel ( I do not do these cases). Certainly send the family member a written certified mail notice of what they said, why it is false and demand they delete the false statements or you will take action and demand damages and attorney fees. It helps if you have actual proof that what is being said is false. Remember, opinions are not actionable.   Good luck... Read More

Bad news, growing in Michigan is illegal. Bad news for them, there is a limit to how much they can grow and, if they grow too much, they can be reported for an illegal grow. However, an action for nuisance might be possible. You will need witnesses, get 2 or 3 people and film them and their reaction to the smell.... Read More

What are my rights as a tenant renting a joint owned home?

You need legal counsel for this. The lease may be valid but you might find yourself facing eviction after the sale.

You are entitled to a Warranty Deed. While a quit claim transfers possession, a Warranty Deed gives the buyer title insurance and believe me, you want title insurance. Send the seller a note confirming the down payment and demand you close at a title company. demand an inspection with a right to cancel if the home fails inspection (or require the seller to fix). You can hire legal counsel to perfect your rights, the first question is if there is even an enforceable contract for sale.... Read More

Your Landlord might be in violation of the security deposit act. You need a solid landlord tenant law attorney, you may be entitled to damages. Landlords are required to STRICTLY comply with the statute. Security deposits are escrows and do not pass to the landlord without compliance. Depending on the facts, this could be a very good case. ... Read More
