What do I do if I was served two VPO's the other day by a sheriff?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
You definitely need to hire counsel. The incidents seems far removed to warrant a protective order today, unless there is more to the pattern of contacts than indicated here. Secure counsel as far in advance of your court date as you can. Be straight with counsel. Don't worry about trying to look as good as possible to counsel. Give him or her all the facts, good, bad or even downright ugly. Any dancing around or dodging something unfavorable to you can hurt you, because counsel will not be prepared for it when it comes up if you do not set your self-image aside and give all relevant information to your counsel. Best wishes.... Read More

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Depends. Are you charged in juvenile court, or are you charged in adult court. Also depends on prior law contacts and results. Talk to your retained or appointed counsel for specific applicable to your circumstances.

Can my son live our house if we have guns and he has a felony conviction for child neglect?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
The question depends on whether he can be treated as having constructive possession. Violation of his probation takes a very low standard of proof. It isn't that you can not own firearms. It's that it may be less than a stellar idea for him to rely on my parent never told me the code, particularly if there is an automatic record of each entry into the closet.... Read More

Am I in trouble for supervision violation for misdemeanor?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
Possibly, but fixing your foul up doesn't hurt. You may have bought yourself some extra court costs as well.

Yes and no.  By depositing the check, you probably did agree to the terms, but the law provides that you have at least a week to revoke any release or waiver of age discrimination claims.  If, as I expect, your severance agreement contained such a release or waiver, I believe you would have the remainder of the week to revoke your acceptance by returning the money.  It is possible that the severance agreement also provided, explicitly, that you would have a period of time to revoke any acceptance.   ... Is there any possible way my little sister and I can leave my dadโ€™s house?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
You are unsafe, according to you, but your little brothers are safe? One does not sound like the other. Your father is facing charges. Your mother is involved in drugs. How DHS is not already all up in your young life is a bit of a mystery. Your aunt could get counsel and seek an emergency guardianship as part of an effort to seek a more permanent guardianship. She doesn't have to ask for all children. Frankly, if you are being hit by your father, you might be better off in a foster home if your aunt can't or won't act.... Read More

If I am a victim in a criminal case, may I contact the defendant and/or his defense attorney?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Criminal Law
You are a witness. You can speak to defense counsel, or not, as you elect Unless you have been ordered not to by the court, you can speak to the media, though they may eat you alive if you do. Do not contact the defendant directly. You may not be prohibited, but it puts him in a dangerous spot due to his no contact order.... Read More

What can be done if my brother stole my wifeโ€™s car and has moved out of state?

Answered 10 years and 8 months ago by Gisele Kathleen Perryman (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Personal Injury
First of all, he did not steal the car. She lent her name to him to enable him to have a car. I hope it is a lesson learned. As to the title, if it is titled in Oklahoma, she can get a duplicate license. When it comes in, she can sign the back of it, as if she is the seller. She will need to also fill out the bottom attachment. Send the now endorsed title to your brother. Then she needs to go to a tag agency to make sure she gets her name off the title. Now, if she also lent her name to the loan, she's in a mess, and may be obligated as to the dealership and/or loan company. In that case, she may be obligated to pay the loan, if your brother does not continue paying. If title is in a state other than Oklahoma, you will need to get legal advice from someone licensed in the other state. Also, she may still be liable for the tollway tickets, but you need to seek advice from a licensed attorney in that state, as there may be exceptions.... Read More

Will DHS give legal godparents the child if taken away?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
DHS may consider asking the godparents if they would like to become foster parents for the children, but have no mandate to do so. Likewise, DHS may consider a kinship placement, but is under no mandate to do so. Unless a placement by DHS results in harm to a child, the court is not going to override decisions by DHS on placement.... Read More

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Oklahoma age of consent is age 16. However, there are ways for an adult and a minor to run afoul of the law all the same. Sharing explicit sexual nudity via sexting/texting/snapchat,etc. come to mind.

Can I return the car that I bought in 2008, bad credit, high interest and transmission breaks down on the way back from the hospital?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Bankruptcy
Your financial circumstances seem dire. You can turn the car in. They can sue for breech of contract. You can probably handle a judgment as a person who is likely judgment proof. Speak to an attorney of your choice. Most of us provide an initial no obligation consultation.

What can I do if my lawyer quit representing my case and did not tell me?

Answered 10 years and 8 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
Find a new attorney. Did the attorney die, retire, withdraw due to non-payment, or was there some other reason. It can make a difference.
