Answered 10 years and 5 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
Presumably you both have counsel for your divorce. If not, now is the time to rethink the decision. Working through counsel, and a willingness to work together in a spirit of compromise, an agreed order can be achieved.

Answered 10 years and 5 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
You can talk to Human Resources or your boss's supervisor or both. If it wasn't a bad evaluation, don't expect massive changes to take place. ?If boss is an asset, the boss will be told do not do it again, and to evaluate you anew and likely little else will happen.

It would be a long shot, even with no priors. You need to cover matters with your existing counsel.

That’s 7 months, which is a long time. I’d let him or her know you will allow a week to get the money to you, following which you will file a bar complaint with the Oklahoma Bar Association. I think that will get you a result. If not, and the lawyer turns out to have a legitimate excuse, the bar will tell you that.... Read More

Can my niece sign temporary custody over to me with papers she filled out and had notarized?

Answered 10 years and 6 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
She could also revoke such an arrangement while in jail or when released even if she is not in a position to properly care for the child. Better to take the time to do right by the child and set a temporary guardianship in place. Another aspect you have not referenced. Where is the father of the child? And where are his relatives? Even if he has shown little interest to date, the mother being in jail might change that.... Read More

Is there a way he can sign over his rights without an attorney?

Answered 10 years and 6 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody

Can I sue a fast food restaurant if my purse was stolen there?

Answered 10 years and 6 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
The business has no liability for a purse being snatched from you inside the business by a stranger to the business. You do need to protect yourself if your keys, home address, banking and credit/debit cards were in your purse. Change your locks at home. Notify your bank and everyone you had a card for in your purse. Not just the credit cards, but store specific cards as well. Have the accounts closed and new accounts opened. Ask the bank to not link the accounts together, especially if your online codes were in your purse or easily guessed, i.e. your DOB on your license or weak codes like 123456 or password or your last name.... Will DHS or CPS show up after sending me home, knowing we both tested positive for THC at birth?

Answered 10 years and 6 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
It is possible for DHS to appear. This can, but does not have to, result in a removal. It might be less. A lot will depend on whether you still use, are nursing and your attitude. Reaching out to counsel in preparation might be useful for you.

Can an attorney for the lender seize my only income, which is social security?

Answered 10 years and 6 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Bankruptcy
If your sole income is social security, it can not be garnished. If you are baking cakes and selling them and putting that income into the same account as the ss funds, you'll likely have to prove what is ss and what is cake money. Keep your ss money separate from any other source is the lesson there. You still owe on the debt, unless you discharge it in a bankruptcy, but they can not garnish the ss money. However, should you win the lottery this weekend, they could come after those funds. If you are being told otherwise, you are dealing with someone who doesn't know, or who perhaps hopes you do not know and will agree to start sending payments. Do not do that. You do not have to....
