Answered 9 years and 11 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
File for divorce in the jurisdiction where you presently live if you meet residency requirements. For Oklahoma, the requirements are residing in the state for the past six months, and in the county where you are filing for at least thirty days prior to filing.

How can I take away his right without getting my kids involved?

Answered 9 years and 11 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
Seek a step-parent adoption. Use counsel. It appears it may be possible to proceed without his consent. Doesn't mean he can not object. You do not have another avenue available.

Can I move with my unborn child if the father is stationed out of state?

Answered 9 years and 11 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
You appear to be a pregnant unwed mother. As you are not married, the putative father has neither custody nor visitation rights until either he, you or the state, if you are receiving state assistance, takes the putative father to court and establish him as the legal father. He can seek custody or visitation if he elects, as part of a paternity proceeding, but if he does not, he will simply have a financial obligation to support his child. Not every person, male or female, who helps create a child, stands up to be counted. So, at this time, unless the state or you or he already has an active action, you can move, or not, as you elect. If there is an action in place, and if you do not have counsel, reconsider that choice. If you do have counsel, ignore everything I just wrote and go see your counsel. He or she is in the best position to advise you.... Read More

If the other party can't be found, how do I still get a divorce ASAP?

Answered 10 years ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
There is no ASAP when the other party can not be found. You will need to make efforts to serve the other party, and document the efforts. Then, if the other party remains in an unknown status, you make application to the court to serve the person by publication. Once the court approves, if it agrees that sufficient effort has been made, you then publish the notice in the appropriate paper of record for the appropriate number of weeks. If you reach this point and still do not know where the other party is, a divorce can be granted.... Read More

It depends upon (a) whether you knew of the lies during the divorce or only learned of them after the divorce was final and (b) how long it has been since your divorce decree was entered.  Check Rule 60.2 of the Tennessee Rules of Civil Procedure for the grounds and time periods for reopening a divorce due to newly found evidence, etc.  Cathy Naugle, Boise, Idaho family law attorney merrisnaugle.com    ... What are my options after I called my bank to surrender my car but they wonโ€™t pick it up unless I sign a paper?

Answered 10 years ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Bankruptcy
Until you have at least one missed payment, they wouldn't have a right to pick up your car. that's why they want something in writing, not a phone call. Tell the bank when you are coming and request they have their paper ready. Arrange for a friend to follow you to the bank. Deliver the car you want to surrender, sign off and have your friend drive you away. If no friend is available, take a cab away from the bank. If your bank is in another city or state, that makes it harder. Maybe a friend or someone else you know can hold the car until the paperwork is in order.... Read More

What will happen if I stole $1,535 from my employer and admitted to it and left the company?

Answered 10 years ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Whether you talk to the detective or not, you will likely be charged with a crime. You already made an admission to the employer regarding your actions. If this is your first time in trouble with the law, you will likely be treated as a first-timer. Before you waltz yourself voluntarily into the police station and do their job for them, you might, read that as you really should, decide to contact a criminal defense attorney first.... Read More

I missed my rule 8 court date so a warrant was issued for my arrest, what can I do to stay out of jail if I'm on probation?

Answered 10 years ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Act quickly. You want to work this out by being proactive, not by talking to the judge via a video arraignment after getting arrested because your head was in the sand. Talk to your attorney or other counsel of choice. Talk to your bondsman to be certain he/she/they are willing to stay on your bond. Do a walkin with counsel and bondsperson present to surrender yourself. Do not try to bamboozle the court with a ham fisted excuse. The bottom line is it was your responsibility to be present and you were not. Own that. It will make a difference. Do not blame a boss, a spouse, a main squeeze, a doctor, or anyone else. You blew it and you are truly sorry.... Read More

Can you be served a warrant for an unpaid check cashing loan?

Answered 10 years ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Not paying back a loan is typically a civil matter. You would receive a summons and a petition on unpaid debt, not a warrant for an arrest.
