Do I legally have to pay a parking citation from a private company?

Answered 10 years and 3 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Bankruptcy
You do not indicate the amount. You do not indicate why you were ticketed. Inside ten minutes would not seem to exceed any limits which might be posted. Were you parked in no parking area, or handicapped, or in more than one space. Pay it and move forward, or contest it and devote time and treasury both to the matter.... Read More

It is not clear he could avoid the charge even if you went to the prosecutor and threw yourself at his or her feet sobbing take me, take me instead. It was my firearm, he had no idea I even owned it, let alone have any knowledge I kept a loaded firearm in the vehicle I told him to go use.

Are they still liable if my license needs to be reinstated?

Answered 10 years and 3 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Start treatment for your injuries. Engage counsel to assist you on the financial recovery. Counsel can file a claim on the truck driver company's insurance on your injuries, your daughter's injuries and the property damage. Let your counsel deal with the insurance folk. If you are called by anyone, simply and without explanation, refer the person over to counsel. All they really want from you is a way to deny or reduce your claim, so let counsel deal with them. The truck driver does not decide liability, nor do you. Even if he were actually 'pushed', the driver was too close to you if he made contact into your vehicle. His company can seek out the other driver to go against that person, if the person existed at all. You have your own separate criminal legal issue. Driving w/o a valid license is an offense, but your lack of a license does not decide who is liable in the accident. Do not delay in securing counsel. Depending on who you select for counsel, he or she may be able to address the accident and the DL issue. Many of us are still general practitioners and have experience in several fields of law. Best wishes for a complete recovery to both you and your daughter.... Read More

Does he have to pay child support if she flat out lied to him about the baby being his?

Answered 10 years and 4 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
A child born during a marriage is presumed to be the husband's. After two years, if unchallenged, that presumption holds, unless the bio father appears, and the named father, bio father and mother are of one accord, and the court accepts, that the bio father should become the legal father. There may also be room for the two year clock to be on hold if the husband is active military. You do not indicate how old the child is, and it is not in son's favor that he has apparently not challenged the paternity before a divorce went through, but seeing counsel is necessary if there is any opportunity to undo the lack of action to date....
