Sorry - but you are "workin it" here and thats not productive. Why is what they billed the insurance carrier of any consequence to you? This sounds a lot more like an effort to weaponize this issue to address OTHER issues or problems you have with the company at issue. That stated, you are not likely to "get your money back" on that notion, but you can always try. ... Read More

Sorry - but its not proper to provide you advice to pass on to her based on how you relate her issues. The advice would be that if SHE has legal questions about her lease she will need to hire a tenant lawyer to review it with her and go from there. If its not important enough to spend the money to hire a lawyer to review it and provide proper advice then that speaks to the importance of controverting the issue at all. In that case she should go the extra mile to do what the document says to eliminate any legal issues from arising. ... Read More

Cancelling a Contract/Promissory note for selling my car

Answered 4 years and 11 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
The only person in breach of contract would be YOU trying to nullify the agreement arbitrarily after you signed it. That stated, you may also be in breach of your loan by doing so as you have jeaopardized the banks collateral. You need to retain a lawyer ASAP to try to address this immediately before you end up getting reposed and sued. ... Read More

You tell us ....you negotiated the deal and already sent money. If you have questions as to why the dealer is asking for more money look at your contract terms and ask the dealer directly.

Not without facing an eviction if the LL disagrees. Its obviously a mistake. Trying to skim stuff you aren't entitled to rarely goes well.

You can't. A cosignor is not a co-owner. You are a guarantor for the payment with no interest in the vehicle.

Why would this not be an issue for withholding rent under Fla. Stat. 83.60/83.51? What do you expect the tenants to do? Use thier hands? Also you broke the law using her security deposit to pay rent. Ummmm hate to tell you but the lack of due diligence is YOUR issue not the lenders nor the sellers nor body shop. Neither a car dealer nor a lender is obligated to make sure you have the coverage you want or need on on a car you purchase. If there are obligations beyond finanical responsibility limits, such as comp/collision required for financing, that is your responsibility to secure and is typically spelled out in the financing paperwork. As it is your vehicle and your finaincial exposure, the due diligence is equally yours. At this point, if the crash was some other persons fault, you need to focus on gettting them to pay for the damages, but you need to keep making you payments to the bank, in the meantime. Otherwise, if you wrecked your car and it was uninsured, you either need to make the payments to get it fixed and keep making your finance payments OR of thecar is totaled, see what can be done with the lender to settle the debt.   ... This is the reason you hire a buiness lawyer to address such issues and draft a contract to protect you and achieve those goals. If you are tring to cobble your own contract together you are already set up to fail.

CANCELLING A CONTRACT

You generally won't and the value of such contracts usually make it cost ineffective to fight over whencompared to legal fees and costs.

You would need to have a lawyer review the transaction and paperwork to figure out what is going on. It makes no sense that a dealer would do maintenance work on a used vehicle that THEY deemed required at thier expense. Some facts are missing here.

Can I sue Vendor for theft by taking

Answered 5 years and 4 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
So wait, you had a work project that if not done cost your business $4,000,000.00 dollars, and this was handled by you and your wife? Without a lawyer that would have cost a tiny fraction of that? And that put you out of business separate and apart from the COVID issues? There is plainly a whole lot more story to this and that unforunately will likely entail you retaining a lawyer now, at greater expense than if you hired them at the beginning, so start sorting all this out. This is NOT a DIY issue as you can plainly see the results of that on this issue already. ... Read More

Doctor non-competition agreements are common and often very broad. There are some ways to work around them but it takes surgical precision and skill of an experienced attorney working in this area. was there a written promise of opportunity to join the practice as a partner? Were their other promises made. I strongly recommend you reach out to an experienced attorney and firm who works with medical practices and these types of issues. This is not the typical non-compete situation. There may be opprotunities to renegotiate with the practice and purchaser that would be more appealing for her as well.    We work with many medical practices and doctors and would be happy to discuss these issues with your wife. ... I am so sorry for your daughters health.  You did not say what you are trying to contract for? to contract  hospice?  Does your daughter have an Durable POA or Advanced Directive done while she was not incapacitated?  I am in Ga so Hope a FL attorney will answer.  In Ga we would (absent a valid POA or Advanced Directive done while not incapacitateda) get emergency Guardianship appointment.  Fairly easy application but need hearing.  If this is for Hospice.  You can check with Medicare  they pay for it.  It may be less formal.... Unfortuately, this is the problem with paying for work in advance. Its not finaincially viable to hire a lawyer or sue over a $1,000.00 dispute. You can do it - but it will likely cost more than the amount in dispute. The notion of a lawyer taking such as case and trying to get paid from the oher party is unlikely and any lawyer foolish enough to do so is likely not bright enough for you to hire, as collecting money from handymen is near impossible. ... Am I leglly responsible for purchasing this vehicle?

Possibly - you will need to have a lawyer review the paper work to get a handle on what you agreed to and also to intervene in the dealer is over reaching. This is a problem based on what is called a "spot sale"

You DO realize its not Oct 2020 yet - right? Thats not for 6 months. If the old lease expired and a new lease was signed for $200.00 a month more, there is no notice required in relation to terms of a new lease. You want to grant an easement to the people across the street giving them (and their guests?) the right to cross a strip of your land for the purpose of reaching the lake.  Such an instriment would need to meet the formalities of a deed.  This is not uncommon, and any lawyer experienced in real estate transactions should be able to draw it up.  It would be customary, but not obligatory, to grant the easement not to the people across the street personally, but rather to the owners of the property across the street, so that the right could be passed on to succeeding owners of that property, and would be binding on succeeding owners of the property being crossed.  The easement will be recorded and appear on any title report.... I am 16 and I want to buy a car without a contract.

Answered 5 years and 10 months ago by attorney Bruce Robins   |   1 Answer
Any time you buy something, that's a contract.  YOu and the other parties to the agreement have agreed that you will pay a certain price and in return the other party will give you title to some property.  There are likely going to be other terms as well.  While the adult with whom you contract is bound by it, you, since you are a minor, have the right to revoke that contract, meaning that any party you deal with would face the risk that 3 weeks after you reached agreement, you can find another car for cheaper, or lose your job, or for whatever reason change your mind and rescind the contract.  Nobaody wants to take that risk, and so they will require a competent adult as a contracting party.... Sorry - but it if you lost your job before it was assigned to the bak and approvied by them, you are likely out of luck. If the dealership doesnt cancel you may find yourself with a vehicle you can't pay for and end up with a repossession.
