What is a valid reasoning for pulling someone over?

Answered 12 years and a month ago by attorney Samuel J. Edmunds   |   1 Answer   |  Legal Topics: Criminal Defense
The police must have reasonable suspicion of criminal activity or a traffic violation to execute an investigatory stop. What you describe does not appear to be a valid basis for a stop. However, it sounds like nothing came out of the incident, so I don't see any recourse for you. If this had resulted in a citation or criminal charge, then you may have had a valid basis to seek dismissal.... Read Answer

This crime carries a mandatory minimum prison sentence. Your husband needs an experienced attorney right away. There may be some viable defenses to the charges, but he won't know until he retains counsel to review the case and defend him. It is also possible to convince the prosecutor or the court to deviate from the mandatory prison sentence, but it won't happen without some skilled legal advocacy. I'd be happy to discuss options with you. Good luck.... Read Answer

property searches

Answered 12 years and 7 months ago by attorney William R. Pelger   |   1 Answer   |  Legal Topics: Criminal Defense
You need to ask a local MN lawyer. My opinion would be that if they did not have a search warrant, the needed the consent of someone who had control over the premises to authroize the search. This could have been another resident of the house, but this area of law is tricky and fact driven and you really need to have a local lawyer examine all of the facts in order to have a sound opinion. ... Why has the police taken my money amounting to $12,530 dollars when they pulled me over if I had no drugs on me?

Answered 13 years and a month ago by John J. Carney (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Criminal Defense
First of all, do not carry money like that around with you. Second, the crime is probably tax evasion. Third, if the money is counterfeit you will find out soon and be charged with a federal crime.Fourth, never talk to the police or consent to a search. They will manipulate young or unsophisticated people who do not know their rights. They will try to get you to inform on others or admit something by lying and saying it is counterfeit or has drugs on it, don't fall for their lies.Get a lawyer to get your money back if you did not commit a crime and pay your income taxes on your tips....
