Some law enforcement agencies have automated readers that scan license plates to determine of the registered owner is suspended or has a warrant. If they do, the police will likely stop the car. Sounds like really bad police work. I am not sure of the motor vehicle laws in WA but it sounds like you dont have insurance or really minimal insurance. Yes, you can sue the other driver for damages and expenses but not pain and suffering.

If no one was hurt, then you will probably be looking at a DUI charge, and possibly an open container charge. They will probably not file charges against you until thy have the results of the blood test back. Separately, the WA State Department of Licensing will most likely try to revoke your driver's license for a year for "refusing" the breath test. You have a right to a hearing to challenge that one year revocation, but you have to send in your hearing request (along with $375) within 20 days of being notified of the pending license suspension. A loss of license for a DUI in Mississippi carries over to all states. You can't move or try and obtain a license in another state to avoid a DUI. I don't have enough info to address your question regarding a "hardship license". If this is your first DUI, license suspension is for 90 days. You can petition for a occupational; license through Department of Licensing after 30 days. If you have had multiple DUIs, or you refused to take the breath test, you cannot get an occupational license. There is no waiver of suspension.... Read More
