It is possible to have a felony expunged in Michigan but I am afraid you are little bit too early according to the statute. I believe you will have to wait until the five years following the end of your probation before that can be accomplished, and that will only be accomplished or bowl if you have kept yourself absolutely out of trouble since. You're welcome to call my office with details and we will be delighted to assist you as soon as you have qualified.... Read More

Only a few types of misdemeanors or felonies can be expunged, and only after 10 years (for misdemeanors) of good behavior, or after 20 years (for felonies) of good behavior. The only way to get arrest records expunged is if you were arrested based on false information and you were never charged. Very few cases fall within this exception.... Read More

There are only a few types of felonies that can be expunged and only after 20 years of good behavior. You don't have to hire an attorney to file a petition for expungement, but I highly recommend it.

Did you receive an SIS (suspended imposition of sentence)? With an SIS, the court dismisses your case after you successfully complete probation and any drug classes that the court orders you to complete. If you just pleaded guilty and did not receive an SIS, then you have a conviction for misdemeanor possession of marijuana on your record. This will stay on your criminal record permanently and it can never be expunged. If you apply for a job and the potential employer asks if you have ever been convicted or pleaded guilty to a drug-related offense, the honest answer is yes. You can't treat it like it never happened because the potential employer will run a criminal background check and see the conviction for marijuana possession and they'll know you're lying....
