i have been convicted of two 3rd degree felonies in tx can they be expunged?

Answered 9 years and 7 months ago by Mr. Richard Keith Oliver (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
Unfortunately, you cannot have a conviction sealed or expunged.  However, on those facts, you should consider meeting with an appellate attorney to discuss whether a writ of habeas corpus might be worth pursuing. The writ process is expensive, difficult, and a long shot. But, a successful writ can reverse the convictions. You would have a second chance to fight the charges. I don't know enough about the case to tell you one way or another, at this point. But, that avenue is the only one availalbe to you, at this point.... Read More

Depending on the severity of the offenses, location of the Court, and mitigation that you have taken, getting an expungment should be around $1,000 but not gaurenteed. If you are eligible, not knowing that you are, it would only benefit you to get an expungment. Please find counsel to assist you in this matter.    Best,    Nicholas Froning  ... Read More

How do I get my felony dropped to misdemeanor?

If you had an actual plea agreement from the judge and prosecutor to reduce to a misdemeanor, you have a right to have that enforced, although it may be a matter of the proper paperwork was not filed when you were discharged from probation.

How can I fix a controlled substance charge 20 years ago?

Answered 9 years and 9 months ago by attorney Jay A. Rigdon   |   1 Answer   |  Legal Topics: Expungements
When did you file a Motion requesting the modification? ( it does not happen on its own, you actually have to file a Request for it.) If you did not, do so, stating all the facts. Your best bet would be to hire an attorney to handle it for you.

can I expunge a misdemeanor that resulted in deffered adjudication?

Answered 9 years and 10 months ago by Mr. Richard Keith Oliver (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
If you successfully completed the deferred adjudication, the cases can be sealed; they cannot be expunged. Sealing the records will prevent most hiring companies from seeing the records. I don't believe the Nursing Board would be subject to the sealing order. Still, it is generally considered better to seal records that are eligible than to leave them out there in the open. Feel free to contact my office to discuss further, if you have any questions.... Read More

Is there a fee to exponge and what is average for 2 misdemeanor charges

Answered 9 years and 11 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
If the charge was dismissed, then there is not expungement fee. If you were placed on diversion, there is no average fee because each county charges their own separate fee and you would have to contact the court for the county where the charges occurred in and ask the clerk.

How do I get a felony expunged.

Answered 9 years and 11 months ago by James T. Hanvik (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
Minnesota's expungement process has changed considerably in recent years.  It is now such a common process (with much better guidelines on what the courts can and can't do) that it is contemplated that most people will do this on their own.  If you go to the Minnesota courts web page you should be able to find expungement forms.  Some are specific to individual counties, such as Hennepin County District Court.  It may be different if the underlying conviction was in federal court.  If you have questions, you can feel free to call us at 952/285-1811.... what is the process for getting my record expunged in arkansas for a first time misdomeaner offense of theft of property?

Answered 9 years and 11 months ago by Richard Lane Hughes (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
You must first complete the sentence you were given including any probation (most of the time). After that, you need to file a petition to expunge your record; serve the prosecuter with your petition; ask that the petition be set for a hearing and appear before the presiding judge for a ruling on your petition. That is a pretty simplified description of how you go about getting your record sealed.  ... Read More

How do I get my record expunged if I quit restitution payments?

Answered 9 years and 11 months ago by attorney William R. Pelger   |   1 Answer   |  Legal Topics: Expungements
Not sure if I understand the question but your county, wherever you are, may require restitution and court costs to be paid if you petition to expunge. Which leads to my question of, if you were ordered to pay restitution, then you must have pleaded or were found guilty. You cannot expunge a conviction unless it was a summary offense and you have 5 years of arrest free behavior behind you. You should discuss all the facts with a lawyer as I don't have all the facts here and cannot fully answer your question.... Read More

Does form to purchase weapon on 11c: one year of imprisonment exempt me and allow me to check NO in the box?

Answered 10 years ago by James S. Lawrence (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
There is no such thing as a federal expungement. The only way to get rid of the federal felony is to overturn it by motion in the criminal case, based on legal error committed back when you were convicted, or apply to the President for a pardon. Because of the time that has passed, it will not be possible to file a motion in the criminal case unless it is based on newly discovered evidence or new law that applies retroactively. As long as you have this conviction you will commit a federal felony if you possess a firearm. State laws that give back firearm rights to some people do not overrule the federal law that makes gun possession by you a felony.... Read More

You can not expunge a conviction, unless you are pardoned by the governor. Unfortunately, the conviction will likely haunt him for the rest of his life. It is highly improbable that the governor will pardon him. The governor grants very few pardons per year.

How long does it take for a 8 year old misdemeanor to not show up on a pre-employment background check?

If it is a conviction it will never go away. And, if you were convicted of the offense you will not be eligible to have it expunged or sealed. Unfortunately, it is there forever. Your only option is to contact an appellate lawyer and consult with him/her as to whether or not you might have a shot in a post conviction proceeding called a Writ of Habeas Corpus. Being granted relief on the writ will not totally solve your problem. But, it will be a step in the right direction.... Read More
