You do not qualify for an expunction. Expunctions are only available for cases in which the charges were dropped or the person was found not guilty. You can apply for a pardon but truthfully, it is very unlikely to be granted and it is a very expensive process.

If you committed this as a youthful offender, it should have been sealed.  However, serious crimes are not always given youthful offender status even if the perpetrator is under 17.  I don't know if you have looked up your record, but if it was not sealed under the Youthful Offender statute, it will not be expunged at all.  New York does not at the present allow for the expungement of criminal records as you may have noted that other states do. ... So long as you stay out of trouble and do well for the next several years, I do not think that juvenile crimes from when you were 13 or 14 should be a problem for you. The hiring policies are up to the individual police department, but if you do well in school, preferably go to college and do well, they should be willing to look past it, while considering your explanation of how you turned your life around. You can probably seal the juvenile records, but you will still need to disclose these things. If you fail to disclose, and they find out on their own, then they will most likely disqualify you out of hand.... Read More

If the charges were dropped, otherwise dismissed, or you were acquitted, you can petition for an expungement, but because it was a felony charge it is not automatic.  You would have to show that it would be a manifest injustice not to grant the expungement.  However, if you pled guilty or were found guilty, you cannot get it expunged. Aggravated assault can be expunged. Aggravated sexual assault cannot be expunged. The time for expungement is dependent upon whether or not you received PTI. If you received PTI then we can do the expungement six months after the completion of the PTI. If you received probation, then we would have to wait until after you completed probation and then a specific number of years, normally five years, until we can do the expungement. I doubt that your prior conviction was expunged through a diversion; diversion typically means that no conviction is entered in the first place.    You may or may not be able to get your record expunged. It would depend on whether or not you were convicted and the nature of your sentence. Some sentences for drug crimes are expungeable, some are sealable. If the class of charge for which you were convicted does not allow either, you may be able to seek clemency from the Governor of Illinois with the right to expunge. The Virginia Code is very clear that expungements are only available in cases of "actual innocence" meaning where the charges were dropped, you were acquitted, or the case was otherwise dismissed.  Ordinarily when you plead guilty that charge will not be expunged.  However, I have recently seen some judges granting them anyway, in contradiction of the statute, as long as the Commonwealth's attorney does not object.  In a case like yours where the charge is more than a decade old and you were very young at the time, you might have a chance if you get a very nice judge on a good day.
