What can I do to put the house and my dad's other property in my name if he died without a will? How much would it cost?

Answered 12 years and 7 months ago by John P Danelon (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Family
If he died without a will, then all his property would have to naturally proceed through intestate succession, handled by probate court. It becomes fairly complicated depending on his marriage status and how many children he had, but probate is meant to parse out the details.

Can I deny visitation to the mother of my step children seeing as there is an active CPS case against her?

Answered 12 years and 8 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Family
There is not an active case against her; there is only a complaint. Only if CPS takes her to court is it active. So no, you cannot keep the children away from her. If your husband is concerned about their health, he should go to court and ask for a modification of the custody order.

How can I terminate a father's rights if he lives in a different state?

Answered 12 years and 9 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
He needs to sign off his rights in front of a judge in the state where he lives. While the custody case may be in Ohio, I think that you may be able to do the adoption here in Idaho. Adoption is somewhat complicated and it may be useful to consult with an attorney.

Can I get a divorce and full custody of my kids if the father is irresponsible?

Answered 12 years and 10 months ago by Jonathan Edward Shimberg (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Family
I have no idea what you think you will do that allows for him to obtain custody of the kids, but if you have been the primary care giver, that is what the court is concerned with - stability for the kids as much as possible.

How can I get a court appointed attorney for filing disability and POA?

Answered 12 years and 10 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
You probably cannot get a court appointed attorney. If your aunt doesn't have any money, you could petition the court on your own to be named the guardian and conservator and ask for a waiver of the fees. However, if you have any money, I suggest hiring an attorney because it sounds like this will be a fight and it better to have someone who knows what they are doing to help you.... Read More

How can I be my grandmother's guardian?

Answered 12 years and 11 months ago by Ms. Jessica M Cotter (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Family
You should file to be appointed the Guardian and Conservator for your aunt. It is an involved process and you should be cautious about attempting the appointment without the assistance of counsel. That being said the are forms and instructions available in Maricopa County at http://www.superiorcourt.maricopa.gov/SuperiorCourt/Self-ServiceCenter/Forms/ProbateCases... Read More

How can I be my grandmother's guardian?

Answered 12 years and 11 months ago by Laura A. Deeter (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Family
You have to file a Petition for Guardianship with the Court. There are two forms of Guardianship, Person and Estate. Person addresses day to day decisions about your grandmother, such as making sure she has the proper medical treatment and care. Estate is control of her assets and making sure her bills are paid. You will need a report from her doctor stating her medical diagnosis and why she is not capable of caring for herself. I would recommend consulting with an attorney who practices in guardianship before you file.... Read More

How long can my boyfriend be held in juvenile?

Answered 12 years and 11 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
They can probably hold him longer than that if the judge thinks it is appropriate. The judge could demand a bond which dad doesn't have to pay. In the greater scheme of things, your boy friend has a lot of problems and some time in juvie with education and a time to detox might be the best thing for him.... Read More

Is there anything I can do get my daughter if I fear for her safety?

Answered 12 years and 11 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Unless you have more than a generalized fear, I think your best bet is to go to court on the 24th. You could also start a custody action.

The remarriage of the the parties causes the previous custody arrangement to become inactive. The custody and parent time for all of the children will need to be addressed in the new divorce proceeding.

Your question admits that the property does not belong to you. Your question does not allege there was a storage charge to be paid. The property is owned by your daughter, and she has a right to reclaim it.

Are we obligated to give the stuff my daughter let us store for years?

Answered 12 years and 11 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Family
A desire to keep the items and the stated reason of their existence in your home is simply storing items for her seem rather inconsistent. Even when family members are made at each other, furniture ought not be the fuel for further family fires. Arrange a day for her to pick up her items. If you prefer she not enter the house, arrange for someone to set the items in the drive on the scheduled day.... Read More

Is it yours? Are you using it? Did you tell her you were going to charge her for storage? You can force her to sue you for it, but I generally go by if it isn't yours, you should give it back.
