So do you have a question? If you had counsel, and he recovered the policy limits, then it's unlikely that you will be able to pursue further relief if you already signed the settlement agreement. You should have another attorney review the settlement agreement to see if you actually released the at fault driver.... Read More

Yes the boy can be charged with first degree murder. There is no self defense claim if another party kisses the killer's girlfriend. There may be a mitigation defense due to murder in "the heat of passion", but that doesnt apply where there has been a "cooling off period."  It appears that you need to get an attorney and you should make no statements to the police without the presence of your lawyer. ... Do you know if the attorney has malpractice insurance? Was this something where she missed a statute of limitation's filing deadline ? These cases are difficult because you have to prove first that you would've won the underlying case, and secondly that the attorney committed negligence that was the proximate cause of you not being able to win the underlying case. More information would be needed. Discuss with counsel in a private phone conversation. ... Read More

Yes, I can prepare a will or trust if you like and can force a sale if necessary through a "Partition" action.  My office is in Anaheim, but that should be ok.  Most things are accomplished online anyway.

Is there anything I can do?

Answered 4 years and 6 months ago by attorney Jeffery J. Czech   |   1 Answer
Is there a way for you to buy the others out so you own yourself?  This may be obvious, but it is really the only other thing that can be done outside of a sale, which they can force upon you with a "Partition" action (a lawsuit).  You can do the same-force a sale that is- and requesst that they pay you all of the moneys you spent on upkeep.  But since they want to sell anyway, I suggest you simply try to work it out because adding a lawyer to this would drain equity fast.... So technically in every lease there is a implied covenant of quiet enjoyment and an implied covenant of good faith and Fair dealing. This act would be something that Could breach that covenant because it is pretty disturbing, and it also disturbs your right to be left alone with your own personal property and privacy, so if you do so desire you could bring an action to evict her if you signed a lease with her. ... OK so if the passport is in your name and you are over the age of majority, then there is no lawful right that your parents have to confiscate something that belongs to you. If they have taken this without your permission, that is a crime, and you could contact the Police department and file a police report. If that legal step does not result in anything, then you could file a lawsuit in court to have them return what they have wrongfully taken from you. This would require you to file an action in Municipal Court in California for a writ of replevin, to return an item of personal property that has been wrongfully taken. In your lawsuit in addition to recovering your passport, you could also ask the court for attorneys fees, Court costs, and any damages that you have incurred like motel and airplane fees expended for travel that cannot be refunded.... How to get my money and my name off house

Answered 4 years and 8 months ago by attorney Stephen Arnold Black   |   1 Answer
OK so if two joint tenants Listed as owners on a piece of property cannot agree on whether to sell or not to sell, then the person that wants to sell the property has to file a partition action against the other joint tenant or cotenant and the property will be sold pursuant to court order, and the proceeds will be split evenly after expenses and fees and court costs are paid. So just retain a real estate attorney to initiate a partition action against your boyfriend.  ... Read More

Can my employer force me to wear masks of a specific color?

Answered 5 years and a month ago by attorney Bruce Robins   |   1 Answer
An employer can require its employees to wear a uniform, although in California the employer is required to pay for it, which your employer has done.  If you can show that the disposable masks are unsafe, you may have a case, but I think it makes more sense to simply wear a cloth mask under the disposable one.  I've started wearing 2 masks as a matter of course these days....
