It certainly sounds like you are the victim of some form of fraud. Both the moving company whose truck and movers did the actual move as well as the website that sold you their services can be found liable. While the actual movers might claim they had no knowledge of the bait and switch done against you, the website and the mover refused to proceed until they had you on the hook. Trying to sue online sites can be difficult especially because getting service of process can be a challenge. But the actual moving company can be found; let them file their own claim against the website. You might want to hire legal counsel for this. Cases can take longer to do that most people think. I don't know if your lawyer is doing a good or bad job on your matter. First, go to the court and look up your case's register of actions (the court can give it to you or you can look it up online at the court website).  Has it been filed? If it has been filed, has the other side been served? These are key questions to determining how they are doing for you. You certainly can tell the lawyer that you are dissatisfied and what they need to do to fix things. Just know 1 thing, changing lawyers is almost always a disaster for the client. Telephone Consumer Protection Act 47 USC § 227 allows you to sue these people but, if they are not in the US, you will get nothing and they are uncollectable. File criminal against him and sue him in district court for damages. Demand restitution in any criminal case. Call him and tell him to return it immediately. Tell him you can overlook what he did if does the right thing otherwise you will hound him forever. Tell him you will take a judgement against him and you will garnish his wages forever.
