There is statutory procedure that must be followed before disposing of abandoned personal property. Basically, you have to give her thirty days written notice that she has to pick up her property. At the end of the thirty days, you can sell the items or donate them to a charity. What Pres. Obama has done is stated that the laws will not be enforced. It is a major constitutional issue as to whether he can undo by executive order laws passed by Congress. At this point, nobody knows what will happen. As it stands now, the laws passed by Congress are still valid, although the President has said he will not enforce some of those laws. One good place to look is at the website avvo.com. You can specify the area of law, and the location, and lawyers will be listed for you. You can click on the lawyers' names and go to their pages that have info about the lawyers. How do I fight back someone who gave me gift money and now wants it paid back?

The main issue will be whether it was a loan or gift. Is there any documentation (note on the check, etc.)? If not, the court will have to decide which it is. All you can do is wait to see what the other side does to collect the money. Most lawyers I know would gladly provide that information and may be ethically required to do so. They may just be trying to scare you. If you get any more calls, ask that they put everything in writing and mail it to you. If you actually do get any mail, show it to a lawyer.

You will not be able to sue him unless he lied to set you up. Truth is a defense to libel and slander. If you did what he said you did you cannot sue. Unless you are in a union or have tenure or a contract they could have fired you for any reason unless it was discriminatory anyway.
