dental malpractice

Answered 11 years and 9 months ago by attorney Joseph Miklos   |   1 Answer   |  Legal Topics: Medical Malpractice
I am sorry to hear about this. Dental cases are a specific type of medical malpractice. Best bet is to contact a dental malpractice firm (they specialize in these types of cases) and share the details of the incident. Hope this helps, Dr. Guy Regev.

Iatrogenic death (death caused by treatment) is very common and certainly may constitute a medical malpractice case. C diff colitis can be a consequence of antibiotic treatment but must be timely diagnosed and treated, which would be my concern in this case. Please contact us at 877ask4sam for an evaluation of this case. Thanks, Dr. Guy Regev.... Read More

I am sorry to hear about your situation in terms of the discharge. Once doctors begin seeing you there is a formation of what is referred to as the "doctor-patient" relationship which carries certain duties and expectations with it. If a doctor does want to "terminate" a patient they must follow certain methods to doing it which may include assisting the patient with finding a new doctor. At this point I am most concerned about you finding a new provider as soon as possible given pregnancy is such an important time for monitoring and so you can get better advice as to how to reduce your smoking further during this time. In terms of the possibility of a lawsuit, your best bet would be to contact a medical malpractice firm and providing more details regarding the incident. Thanks for contacting us, Dr. Guy Regev.... do I have a medical malpractice case?

Answered 11 years and 9 months ago by attorney Joseph Miklos   |   1 Answer   |  Legal Topics: Medical Malpractice
Thank you for contacting us and I am sorry to hear about your father's medical condition. The key issue here as you said is whether this blockage was missed 3 times or whether it developed later after those tests were done. It does seem odd that his leg was significantly swollen and painful as well. We would have to hear more about this case in order to help you assess the possibility of a case. Please contact us at 877ask4sam. Thanks, Dr. Guy Regev.... Read More

IUD

Answered 11 years and 9 months ago by attorney Joseph Miklos   |   1 Answer   |  Legal Topics: Medical Malpractice
I am sorry to hear about your condition and the problems you have been having with the physician. Certainly it is frustrating to be sent away when you are suffering. I would try another office to see if someone else may accept your insurance. It seems from your brief synopsis that all of this happened rather quickly (few weeks) but it may be worth it to call a medical malpractice firm to review the story for possible negligence. Thanks, Dr. Guy Regev.... Read More

could a malpractice suit be filed against multiple care providers and a hospital?

Answered 11 years and 9 months ago by attorney Joseph Miklos   |   1 Answer   |  Legal Topics: Medical Malpractice
I am sorry to hear about your mother's diagnosis and the chain of events that took place at the hospital. To answer your initial question, you can (and it is commonly the case) sue multiple care providers - this is logical as there may be multiple people that act negligently in any given case. The key issues we would need to investigate in your mother's case are why exactly there was no follow up done when working up these imaging studies and could have such follow up have significantly improved your mother's prognosis. Such mistakes in healthcare are not excusable when they affect those closest to us. Please contact us at 1877ask4sam for a consultation. Thank you for writing to us, Dr. Guy Regev.... Read More

Potential HIPPA violation...?

Answered 11 years and 9 months ago by attorney Joseph Miklos   |   1 Answer   |  Legal Topics: Medical Malpractice
Thank you for contacting us and I am sorry to hear about your situation. Certainly you must feel violating that your personal information was communicated to other family members without your permission (assuming you are a non dependant). Since this is such a specific part of medical malpractice (I would label this as "psychological malpractice"), the best step you could take is contract a psychological malpractice attorney in NY. They will be most familiar and able to help with this issue. Hope this helps, Dr. Guy Regev.... Read More

dental surgery

Answered 11 years and 9 months ago by attorney Joseph Miklos   |   1 Answer   |  Legal Topics: Medical Malpractice
Thank you for contacting us. It sounds like you may have a potential malpractice case, specifically in dental medical malpractice. The best step you could take is to contact a medical malpractice firm that is specifically dedicated to dental cases (there are quite a few in NY). However, the date of the potential malpractice is concerning as there are strict statutes of limitation in NY. I would make sure to contact a dental malpractice attorney as soon as possible for this reason. Yours, Dr. Guy Regev.... Read More

I am sorry to hear about this incident. While it is impossible to determine liability without doing further investigation, it may be that this dentist used excessive amounts of novicane that may have contributed to the reaction you 4 yo experienced. If you were not informed of the risks of the procedure before the surgery, the doctor did not acquire informed consent from you to do the operation. This sounds like malpractice. You need to acquire a copy of your medical records and consult an experienced attorney as soon as possible. Good luck with the claim. ... Read More
