You might start with consulting an attorney who does both workmen's compensation cases along with intentional torts (personal injury). Your case may be a mix of the two types of law. In the meantime keep treating with your medical providers.

Were you put on any restrictions by the doctor? Normally, one would have a visiting nurse or something to assist. If you got out of bed unaided when you were under the influence of medications, you certainly could have contributed to your own accident. if you have suffered a significant injury, you probably should consult with a medical malpractice lawyer to check out all possibilities.... It appears you were injured on the job. If this is the case you need to contact an workman's compensation attorney immediately to help you take steps to have a non-comp doctor evaluate your injuries.

It is a good question. Landowners are general only liable under the premise liability act. Whether this applies depend on where a person was injured and how. The best approach is to have a good lawyer make sure the trail riding company (and the principals in the company, personally) agree to indemnify you. Then get insurance from a knowledgeable agent. In addition, you want to make sure you have the protections that an LLC or S-Corp afford.... Read More

Your question is very good although your description of the events raises more issues than you probably anticipate. The standard SOL for accidents in Colorado is three years from the date of the accident. Do NOT rely on this deadline. The SOL could be considerably shorter if you have to go after your own insurance company, if your case involves workman's compensation law, if the other driver was working for or with the government or shortened by a lot of other issues. At this point it sounds like the insurance companies are giving you the run around and you need to get a local attorney involved. We are licensed to practice in Colorado and Texas.... Read More

You should contact an attorney who specializes in medical malpractice cases wherever you are located. Gather up all your documents and sit down with someone for an initial consultation. This is the only effective way of determining whether you have a case.

You could be charged with multiple offenses depending on the trooper who responded. These charges include leaving the scene and/or reckless or careless driving. How this effects your out of state license depends on what state you are from and the laws there. You should contact an attorney in your state for these questions. You will either need a Colorado attorney or you will need to appear at the Colorado court where your case is being held. If you fail to appear they are very likely to issue a warrant for your arrest.... Read More

Yes. You already realize that Gold's Gym will raise the defense that you failed to notify them immediately. They may argue that you really injured yourself somewhere else. You will need to prove liability on the part of Gold's and the owner of the land, but it seems that your damages will be easy to prove.... Read More

It depends on the situation. Most calls to insurance companies are monitored and recorded especially when you give a statement regarding your injuries. Statements you make can be used later as admissions in court. It is always best to have a third party talk with the insurance company.

Did you have insurance? If not, you are in deep do do. If you did, then turn the papers over to your insurance company to defend you. If you can prove an "Act of God," then you might be excused, but in any event, your insurance company will take care of it.

You should immediately contact a local personal injury attorney to discuss your case. Most personal injury attorneys offer free initial consultations to determine how to proceed.

Probably not, but what I would do is contact your congressman and push for a court martial. Even if you son was at a place he should not have been, that does not justify what happened. That kind of soldier belongs behind bars, and should not have access to weapons.

It sounds like you have a defense to the hit and run claim, but a jury would be presented with that fact and its believability. Do multiple people have access to your vehicle? Have they all denied using the vehicle or getting into an accident? Was there a victim who can identify who was driving at the time of the accident? If you would like more information on the defenses for a serious case like this hit and run, contact a Denver Criminal Defense and Traffic Defense attorney.... Read More
