I assume that you were served eggs in a restaurant and that you are considering a claim against the restaurant.  Any food sold for consumption has an implied warranty of fitness for human consumption, and if you can show that you became ill from the food served at the restaurant then you have a claim. However, though you have the basis for a claim you must consider what damages you suffered. It depends and were you injured? There are a lot of factors, recoveries and the story to be told that determine liability and value. Also, insurance companies will determine whether it is a person "making their own case," a mill's form letter or a detailed demand package that is the determining factor of an offer. And then is that offer suitable? Essentially, insurance carriers try to negotiate every dollar they can, because every $100 means millions in the end to the Board of Directors. And their lawyers are, respectfully, good at getting one over on novice lawyers and novice victims- you would be basically both. Even in soft tissue injuries, those tissues stretch and scar, or cause corresponding pressure on nerves in the spinal cord, leaving behind permanent problems for some. I have had clients need surgeries years later because of a bulging disk and have their entire world collapse for what seemed inconsequential at the time. Insurance companies want you to settle as soon as possible and treat as little as possible. Attorneys matter. They change their gameplan when a lawyer is involved. For that reason - and the misinformation by TV lawyers and referral services- is why people should consult lawyers who take the time like on sites like this. Because of the economy, more lawyers are jumping into personal injury and should stick to what they know. I would stop raising all of these minimal issues. Without starting a 5 page debate about "I am just enforcing my rights" thesetype of issues can backfire if you get involved a legitimate legal case to paint you as an opportunistic professional plaintiff, regardless of whether its fair or not. Credit cards are not courts to resolve disputes. Be careful as the reversed charge could cause the mechanic to exercise mechanics lien on your car. That’s awful – very sorry that happened to you.  Sounds like you’re getting a pretty solid run-around.  Get an appointment with a litigation attorney to discuss the matter in detail.  Take whatever proof you have of the claim and all of the correspondence you have from the company/distributor.  The company’s insurance carrier may or may not choose to pay, but given the run-around you're getting, it looks like to get any type of recovery you’re going to need legal representation.  Best of luck.... You have all the elements for a lawsuit, but in reality you would not likely get much, if anything from it.  In order to sue for a personal injury you have to show: 1. NEGLIGENCE - which you have because obviously pieces of plastic do not belong in your drinking water. 2. INJURY - that you were injured as a result of their negligence.  This is where your case falls short because although you were injured, your injuries were pretty minor.  Attorneys who take on these kinds of cases are generally looking for catastrophic injuries, like if you had actually choked and died or suffered brain damage - that would be a great case!  That's because you can collect for your medical bills, for lost wages, and for pain and suffering.  You have no medical bills or lost wages and your pain and suffering would probably be determined by a judge or jury not to be worth that much.  An attorney would never take this case because it requires an enormous amount of work to bring this type of case, so we only do it where the potential pay-off is great. 3. CAUSATION - You have to show that your injuries were caused by their negligence.  That is pretty clear in your case so that is not a problem. 4.  DEEP POCKETS - Another thing we look for in evaluating cases is whether the defendant has the ability to pay any judgment we obtain or whether they have insurance coverage.  This should not an issue in your case because you are dealing with a well-established company. So to summarize, you have all of the elements of a lawsuit, but your case is not worth enough to be worth an attorney's time to take it on.
