If you apply for disability benefits you may or may not qualify and it can often take upwards of 18+ months to receive a final decision.  Your medical history and ability to work or NOT will directly impact your decision on this.  Can I work or not...    If you apply for unemployment insurance you may be eligible and receive income immediately.  It comes down to personal preference...   Attorney Scott Bocchio Legal Rights Advocates P 855-254-7841 www.legalrightsadvocates.com            ... Worker's comp is for people who were injured on the job. Unemployment insurance is for people who were fired. Social Security Disability Insurance, getting your Social Security retirement benefits early, is for disabled people who have paid into the system for at least 10 years and apply within 5 years of the time they last worked. Supplemental Security Insurance is for disabled people who have not paid or not paid in enough years or not applied within 5 years of the time they last worked. From your description, it appears that you are too late to apply for worker's comp or unemployment insurance but may qualify for SSDI.  To qualify, you must be unable to do any job, not just your regular job.  You can apply online at www.ssa.gov.  Most people are denied and must ask for reconsideration (ask for an informal conference so that you can explain things).  Some must ask for redetermination, which involves a review by doctors not employed by Social Security.  A few must appeal further, to an Administrative Law Judge.  You only need an attorney for this last step.  Promptness, politeness and persistance are key.          ... In fairness to any law firm, there is only so much we can do.  We rely heavily on you to retrieve medical documentation from care providers.  We can send out requests, but don't always receive confirmation.  We like to think of this process as a team venture.  If the team works well together we put ourselves in a better overall positon for success.    Attorney Scott Bocchio President Legal Rights Advocates P 855-254-7841 www.yourlegalrightsadvocates.com  ... Social Security disability benefits are based on your inability to do any job, not just your current job.  You can apply at www.ssa.gov. Social Security Disability Insurance is like taking your Social Security retirement benefits early.  If your application is granted, you will receive the amount which you would have received at full retirement age.  After 24 months you will be eligible for Medicare. You can handle the application, any request for reconsideration (ask for an informal conference) or redetermination on your own.  If you must appeal to an Administrative Law Judge after taking these steps, you may want to be represented by a member of the National Organization of Social Security Claimants' Representatives....
