SSDI, unike SSI, does not deduct for earned income.  However, there is a 9 month trial back to work period.  If you remain able to work after 9 months, you will be viewed as no longer disabled and lose SSDI.  If you again become disabled, you can again receive SSDI.

While COPD is a chronic condition which is expected, eventually, to result in death, the Social Security Administration focuses not on diagnosis but on function.  At some point, your COPD may make you unable to work and likely unable to work for the next 12 months.  If so, you may qualify for Social Security Disability Income (essentially like taking your Social Security retirement benefits early) and, ater receiving it for 24 months, Medicare.  You can apply online at www.ssa.gov.  You do not need a lawyer for the first two levels of appeals.  At the third, the lawyer's fees are capped and come out of the Social Security award you receive (if any).  For that, contact the National Organization of Social Security Claimants' Representatives.... Social Security Disability Income automatically morphs into Social Security retirement benefits in the same amount when you retire.  You cannot receive both at the same time.  It seems unlikely that a pension plan would penalize a member for receiving Social Security retirement benefits.  Once you have clarified the situation, take your pension plan and Social Security documents to a lawyer specializing in that area.... Am I still eligible for disability benefits?

Answered 6 years and 5 months ago by attorney Terry Lynn Garrett   |   1 Answer   |  Legal Topics: Social Security Disability
From your description, it is not clear why you were denied.  But it does appear that your lawyer appealed first to the administrative law judge and then to a district court.  Unless the district court's decision contained a mistake of law which was material and reversable, there is no further hope of appeal. However, you may well be eligible for Supplemental Security Income (SSI), food stamps (SNAP), the low income heat and assistance program (LIHEAP), and housing support such as HUD Section 8.  You may want to start by applying for Supplemental Security Income.  ... From your description, it sounds as though you applied too late to qualify for Social Security Disability Income (SSDI) based on your work record.  You may, however, qualify for Supplemental Security Income (SSI) or be able to take early retirement.  In Texas, $1 of SSI automatically comes with Medicaid.  You may qualify for food stamps (SNAP) or Section 8 or other supported housing.  If you live in a major metropolitan area, you may also be eligible for medical care through a MAPS program.  You might want to look at YourTexasBenefits and needhelppaying bills....
