Can I take legal action on a streaming company that is over charging me

Answered 2 years and 4 months ago by Andrew M. Jaffe (Unclaimed Profile)   |   1 Answer
You may wnat to consider hiring a lawyer to send a Cease-and-Desist letter to the streaming service to either return your overpayment or quit the service, or etc.  While a Cease-and-Desist letter has little legal impact, the lawyer's letterhead hets the recipient's attention. This is a relatively inexpensive wat to put the person on notice that you are not going to let these acctions continue and that you are serious about pursuing you legal remedies.  It also tells the person that they coululd get in legal hot wather which will cost them a lot of legal fees if nothing else.  this will often convince them to stop their evil ways.... If they want to spend the money to probate an estate in hope of getting a share of things which are likely to bring little or no money at a garage sale, they can.  The real difficulty, probate or no probate, is deciding who gets what.  If you can resolve that, you can spare a lot of hurt feelings and maybe save some semblance of a relationship with your siblings.... While only the testator can change a Will, in many states divorce automatically means that the divorced spouse cannot inherit regardless of what the Will states.

Under U. S. immigration laws, the issue is not whether a person applies for Medicaid, but whether the person receives Medicaid benefits. If you are not receiving means tested benefits from federal, state, or city, the Medicaid question is inapplicable. Even if you were receiving Medicaid, you would not get into trouble for having signed for your husband’s financial affidavit support as there is no indication of fraud in your case and the prohibition would be against him receiving means tested benefits. Hello my name is Ashley and I am currently pregnant and the father has left me just recently for another woman. I need advice and help.

Answered 8 years and 2 months ago by NA smsattorney@gmail.com (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
What you are asking for to get an answer to is how to alienate a parent right to his/her child. I understand that you may be said because he left you for another woman at this time. There are ways you can make it difficult for him to utilize his rights, but I would prefer you to contact my office directly to discuss your plans and options. Most likely, if you put him on child support, he may want to get visitation and joint custody. Things will be easier for him if you put him on the birth certificate as the child father. Caution, when you are asking such questions, you should not give your personal identifying details on the internet as any public information may be used against you. Personal details of the case should only be provided to someone you are discussing the case with or looking to hire. Anyway, contact my office if you would like to discuss more on this matter. Above answer and comments to questions are for general purposes only and does not constitute legal advice or establishes an attorney-client relationship without a signed retainer. Please reach out to an attorney you are comfortable with working and discussing your case in more details. If you can not afford a private attorney, you may be eligible for a Pro Bono lawyer provided by some courts and if not, feel free to ask about our affordable payment plans.... Read More

I am surprised that your employment is at will, as I would have expected it to be subject to the hiring and firing provisions of a collective bargaining agreement.  As an at will employee, your employment can be terminated for any reason not prohibited by statute.  If you believe that termination of your employment resulted from discrimination based on a statutorily prohibited reason (e.g. race, religion, age, etc.) you may have a claim.  Even if not, however, unless you are being offered something for resigning, I don't see why you would, unless you think it will look better to a subsequent employer than being fired.... Wanting to become a us resident.

Answered 10 years and 2 months ago by Atty. Samuel Joseph Zermeno (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
Hello Nataly. Since you left the US after accruing one year or more of unlawful presence and reentered the US illegally you are now inadmissible to receive permanent resident status until you have lived outside the US for ten years; there is not a waiver available during the ten year period. Look at INA 212(a)(9)(C) - (C) Aliens unlawfully present after previous immigration violations.- (i) In general.-Any alien who- (I) has been unlawfully present in the United States for an aggregate period of more than 1 year, or (II) has been ordered removed under section 235(b)(1), section 240, or any other provision of law, and who enters or attempts to reenter the United States without being admitted is inadmissible. (ii) Exception.-Clause (i) shall not apply to an alien seeking admission more than 10 years after the date of the alien's last departure from the United States if, prior to the alien's reembarkation at a place outside the United States or attempt to be readmitted from a foreign contiguous territory, 14a 6aa the Secretary of Homeland Security has consented to the alien's reapplying for admission. It appears that you are only eligible for DACA at this time until the laws change.  ... Read More

What's the best way to marry a foreigner?

Answered 10 years and 6 months ago by attorney Doreen A. Emenike   |   1 Answer   |  Legal Topics: Immigration
Hello,   It depends. If you have met her within the past 2 years and you are engaged, you may be able to file for a fiancee visa which would allow her to come to the U.S. as your fiancee and then you would need to get married within 90 days. Otherwise you can see if she can get a visitor's visas but it might not be easy to get one. A lawyer can advise you on the best way to move forward (after speaking to you about your own particular situation and your fiancees'). An attorney can prepare the paperwork and file for the fiancee visa while giving you useful advice, watch over your case and give you a good estimate about how long it will take. Also, because an immigration attorney has experience with the immigration service, they may also help you avoid problems which can cause delays on your case.  Generally when our office has filed fiancee visas they have taken many months from start to completion. Good luck.   Disclaimer:  The answers to frequently asked questions are based on limited information available to us.    The answer provided is of a general nature and does not establish an attorney - client relationship.  It is not, nor is it intended to be, legal advice. What the owners decided to do with the fence has nothing to do with what you owe.  If you cause $500 damage to my car, you would owe me $500, whether I used the money to repair the car or left it in the same condition, or junked it.  However, you do not state either that you were sued for the damage, or that you agreed to pay for it.  While I am not familiar with Wyoming law, after 9 years, I'd be very surprised if the statute of limitations on the property owners' claim against you had not expired.... I was denied a non-immigrant visor

Answered 11 years and 8 months ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
Many times there is nothing that an individual can do except apply again after an appropriate period of time. You may encounter a friendlier consular officer. You may also be turned down again since most nonimmigrant visas are given in the discretion of the consular officers. You have also pointed out a reality that if there are no new circumstances, you may be denied as you were turned down previously. I would suggest applying again once you establish stronger bonds with your home country and have a longer period than three months between your applications. What does "dismissed and held for naught" mean?

Answered 12 years and 4 months ago by attorney William R. Pelger   |   1 Answer   |  Legal Topics: DUI/DWI
I havent seen that language in my state but my guess is it means the case is dismissed, for naught, means for no reason, something like that.
