At what point is it considered collusion when working for 2 companies at the same time

Answered 2 years and 5 months ago by Andrew M. Jaffe (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Business Law
I am not so sure that bidding on future work before you leave your present company is proper and you could be creating legal liability for yourself. It seems from your question that your present company is aware you are leaving to start your own construction business.  If this is so, discuss this problem with your current employer. If this is not so, don't talk to your present employer and do not bid on competing work until you have left them. You may wish to discuss your situation with a lawyer in more detail.  Many lawyers offer a free phone consultation.... Read More

No.  You cannot legally withhold an inheritance or disinherit an heir.  Since the sibling will not sign a Small Estate Affidavit, you must file an application for determination of heirship and if, as expected, your sibling does not sign agreeing that you will be administrator, have him served by a constable.  You will need a local probate attorney to guide you through the process.... Lauren, you would not legally be allowed to use any third party brand on your own goods that you sell online.  It would be considered an infringement of the others' brands.  If you would like to discuss further, just let me know. Best, Lisa

Deadlock of shareholders who is responsible for arbitrator costs?

Answered 9 years and 2 months ago by attorney Bruce Robins   |   1 Answer   |  Legal Topics: Business Law
Who pays the costs depends on what the parties' arbitration agreement provides.  If silent, each side would generally bear its own costs and would share the arbitration fees equally.  I can't predict what the arbitrator will decide, but he/she will render an award deciding the issues, as opposed to a mediator who, as you said, is only empowered to try to facilitate a settlement between the parties.... political asylum closed then get married

Answered 9 years and 9 months ago by attorney Alan Lee, Esq.   |   2 Answers   |  Legal Topics: Immigration
Assuming that you were in F-1 status at the time of your political asylum case and that U.S.C.I.S. simply closed your case, the case should not have much effect unless you committed fraud or misrepresentation in your application. You should be able to return home after getting your marriage green card. Although I do not think that you would have a problem with advance parole, it might be better for you to wait until obtaining your green card since you expressed fear of returning to your home country in the asylum application.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. 1. Be careful about seeking a change of status. Your change of status may not be approved leaving you in a precarious situation.  2. A new employer would need to file a new H-1B petition on your behalf. You will be cap exempt. The employer may be able to request a change of status or you will need to depart the United States and re-enter with a valid H-1B visa. It will depend upon your status at the time of filing. 3. You may study while on H-1B status. Whether you could switch to a part-time program will depend upon the school's policy. 4. Speak to the school's DSO regarding your eligibility for PhD OPT.  You can read more at http://myattorneyusa.com/work-visas.... Read More
