To be candid, if you are 18 and dont know what you are doing, you had no business buying a car or engaging in such a transaction and did so at your own peril. Legally, you are an adult and responsible for your own decisions. Other people, and particularly people selling you things, are not obligated to educate you to make a good deal or even a proper one. This has been reduced to an old latin saying "Caveat Emptor" or "buyer beware". first please excuse the typing and word usage as I am using speech to text technology In answering your question I am assuming the issue concerns the personal injury liability settlement with the plaintiff and his or her lawyer. when an insurance company settles a claim the release signed by the plaintiff forever releases the insured, the driver of the insured's vehicle and the insurance company from any future liability for the accident. that is part of the deal. it would only be under the most unusual circumstance where you would have excess liability. if that were to happen you would be clearly notified by your insurance company and they would probably need your permission. I am quite certain that did not occur in your situation, but check with your insurance adjuster handling the claim. I am certain they will explain all of this to you. Since I do not know the facts of your claim and maybe it falls in that very very rare and unusual exception, you may to consult with a lawyer if the insurance adjusters answer is not clear.  ... There is no situation in which your brothers insurance company is being sued for 50k. Florida simply doesnt allow this type of suit. Depending on the injuries suffered, there is a clear possibility that your brother may be sued or ask to contribute in excess of the policy limits due to the DUI. Every personal injury case requires both negligence (including comparative negligence) and injuries. Regardless of the fault issue, you must have a significant enough injury to warrant making a claim for damages (I assume you are not talking about just a property damage claim?).  You also mentioned you were at fault. If there other driver was on the phone but that was not a contributing cause of the accident, it does not matter.
