This is a very common question. It is highly unlikely that you will be pursued for amounts over the policy limits. Plaintiff's counsel simply wants to protect himself by having a document reflecting you are uncollectable so he himself can't be sued for malpractice. Of course its your responsibility for not controlling your car. The steering wheel didn't "lock up" (unless you have a mechanical expert that will testify to such) but rather it is morelikely you over reacted to your negligence on not making sure the lane was clear when you changed lanes, over corrected your steering to the left and sent your car into the median where if flipped. Thankfully you were not catastrophically hurt nor was anyone else, but the fact remains that you are responsible for ALL of the effects of your negligence. ... Read More

Every accident caused by an underinsured driver is minor, the other car was speeding, the other people weren't hurt and are probably faking. Its a simple truism. Obviously, the other side does not agree. To answer the question if there is a claim or alawsuit being made and they have no insuranc, or not enough, they really need to hire an independent lawyer to defend them as NOW will be the time to raise all those defenses and the insurance carrier will place thier own intersts first even when they claim otherwise. ... There is no situation I am aware of where doctors change rates based on the nature of the injury or can refuse to care for you based on the means of injury if you have health insurance.
