After retaining counsel, you can get medical treatment from doctors who will more than likely work on a contingency fee, if you dont have medical insurance. The best approach is to retain counsel so that yours and your daughters claims process can begin. Keep in mind that you shouldnt give any statement to the ins co, or anyone else. These ins co's do not have yours and your daughters best interests in mind.

Your own PIP coverage would cover your med bills and lost wages up until 10,000 dollars. If you dont have your own PIP coverage, but someone living in your household who is a relative, and who has PIP coverage would pay for your med bills and lost wages up until 10,000 dollars. Of course, you can always sue the other driver who was at fault for bodily injury and recover pain and suffering as well as lost wages and medical bills. There would be no lien on any settlement procured against the at fault driver to reimburse benefits you obtained under a PIP ins policy. Finally, Under the new PIP law, there is a very short time period in which to seek medical attention for your injuries or else be precluded from accessing any PIP benefits that you are entitled to. So, dont delay seeking medical attention, and hire a qualified personal injury attorney in Florida

An accident report should have been filed with the police at the scene. IF one was not happened there may be a surveillance camera for the parking area that can confirm the accident occurred. In any event, you have the option to file a lawsuit against the at fault party for the damage to your vehicle. That might get them to contact their insurance company and cooperate.

Its unclear who you're suing. I assume you were a passenger in your own car?, and your gf was driving? is your claim against the driver of the car who hit your vehicle? If thats the case, then under fla's comparative fault statute, you could still have a valid claim against the third party driver, if he/she was at fault or partially at fault, and your damages would be reduced by any fault apportioned to your gf, if in fact she was at fault or partially at fault. Of course you would need to consult with counsel to go over all the facts and determine the best approach on how to proceed. One of the most commonly asked questions by a new client is "what is my case worth". My typical reply is," if you want me to start our relationship with my lying to you, I can give you a number" (and in fact some lawyers will do just that in order to impress the client and deal with the consequences of not meeting that inflated number later). The reason I say this to clients is, the ultimate compensation value of a case is based on many factors, including the nature and extent of someone's injuries. With rare exception, that is unknown early on. Sometimes what seemed like a big injury resolves and what we thought was a minor problem progresses and become a considerable injury. Some injuries may progress be corroborated with diagnostic testing and some injuries may ultimately require surgical intervention.. So there are many factor at play and I am not even talking about insurance company games, where thy claim you were partially at fault, or deny coverage, etc.
One factor in a motor vehicle case is whether they treating doctor will certify that you sustained a "permanent injury'. This is the standard you must meet in Florida to recover most damages against the at-fault party; such as pain and suffering type damages. Also, Florida is a no-fault state, which means you PIP is responsible to pay a percentage of your bills, regardless of how much coverage the other driver has. There is a lot you need to know in order to maximize your PIP coverage. In fact if you do not seek medical care for your injuries within 14 days your carrier will not even pay for those no-fault bills. Whether a doctor certifies the nature of your needing initial medical treatment also affect the amount of your PIP coverage. It is actually far more complicated then what I have above. This is just a short summary. A skilled personal injury lawyer knows how to deal with these issues.
Bottom line, trying to do this on your4 own without an experienced Persona Injury lawyer can and probably will be a huge mistake, unless the injuries are clear and the at-fault company is willing to tender their policy limits to you. Even then there are important considerations that only an experienced personal injury lawyer can assess for you.
When I refer to an experienced personal injury lawyer, be careful before hiring one the TV law firms, with their slick commercial. Understand that these firms spend millions of dollars in advertising bringing in thousands of clients. You need to decide if such a firm can give your case the time and attention it deserves.
