Answered 10 years and 2 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
If you are involved in an accident and do not have any insurance that will pay for damage that you caused, then you can not get your license back until you pay or make arrangements to pay for the damage that you caused in the accident.

Filing Civil Suit - Metro Nashville Firetruck ran over my legally parked motorcycle.

Answered 10 years and 2 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You indicated that the firetruck was responding to a fire so there is a little more latitude given to those performing a public function. There is nothing that you can do until they have responded to the claim or at least had a reasonable time to respond. As a general rule, the only damages that you will be able to claim is the fair market value of the motorcycle. Loss of use will probably not be recoverable in this case.... Read More

Are law enforcement allowed to use highway cameras as evidence?

Answered 10 years and 8 months ago by attorney Mike Friedland   |   1 Answer   |  Legal Topics: Car Accident
the answer is yes, the police can use cameras to find the driver who left the scene. this does not mean they have to, and may not do so. they may not think it likely to work, or simply don't want to take the time to try. these cameras are reusedd and the contect is erased after a short time. if you have uninsured motorist insurance, and they driver made contact with your car, you can file a claim with your insurance, and they have to pay you full benifits. call an atty. thank you, jay stillman... What should i do if I have been in a auto accident with a TN DOT Dump truck in which my car was totalled and the accident was the truck drivers fault

Answered 12 years and a month ago by Mr. Richard Alan Alsobrook (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You should consult a personal injury attorney because an attorney can gather the necessary facts and assess damages.  A personal injury attorney will have the necessary experience with dealing with local insurers, and know what the value of the damages should be.  Most personal injury attorneys offer a free initial consultations.     This is not intended to be legal advice, and is general in its nature. No attorney-client relationship exists or is formed by this information. Furthermore, this does not represent the views or opinions of LexisNexis or its affiliated companies.... Read More

Should I only be entitled to replacement cost for my property damaged in a car accident, or am I able to get full replacement cost?

Answered 12 years and 3 months ago by Mr. Richard Alan Alsobrook (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
You do not mention the state where the accident occurred, and each state has unique laws relating to damages for goods, and insurance laws.  Therefore, it cannot be determined what value to assess to your property.  Insurance companies have interests that are not necessarily aligned with your own.  Therefore, it is a good idea to speak to a local personal injury attorney because a local attorney can gather the necessary facts and assess damages.  Most personal injury attorneys offer a free initial consultations. Can a insurance company hold on the claim ?

Answered 12 years and 7 months ago by Mr. Richard Alan Alsobrook (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Taking advice from an insurance company is questionable, to say the least.  There are time limits that each state has, for filing suit.  Therefore, waiting on an insurance company to give you permission to act may not be in your best interest.  You should consider consulting with a local personal injury attorney because a local attorney can gather the necessary facts and assess damages.  Most personal injury attorneys offer a free initial consultations, and can help you determine the best course of action going forward. DO I HAVE ANY GROUDS TO SUE FOR ADDITIONAL MONIES IF MY CAR IS TOTALED OUT BUT THE PAY-OFF DOESNT LEAVE ME WITH ENOUGH TO MAKE A DOWNPAYMENT ON A CAR?

Answered 13 years and 11 months ago by Mr. Christopher Edward Clark (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Car Accident
Unfortunately, your situation is all too common.  The short answer is, "No."  Insurance policies usually only require the company to pay the fair market value of your vehicle.  If you owe more on your vehicle than it is worth, or if you drive a car that has a low market value, then there may not be much to spend if the car is totaled.  Oftentimes, people owe the bank more than their car is worth, leaving them with a debt.  Some carriers do offer gap insurance to cover that difference, but unless you had purchased that type of coverage, it is not going to help you in this situation.... I suggest that you hire a local attorney with experience in personal injury. It is not up to the insurance company to decide what the case it worth, it is up to the court. If you hire an attorney and then insurance company knows that attorney is willing to take it to court, they will become more reasonable.   Andy Gillin, Senior Partner GJEL Accident Attorneys  ...
