I am sorry but the question that you have asked really can not be answered adequately in this forum. As a general rule, if you incorporate a business, that name can not be used by any other business in Tennessee only but not other states.  I would suggest that you get access to Tennessee cases and read "Men of Measure Clothing, Inc. v.
