Unfortunately, since you didn't pay attention to this several times over, if they can't get it fied for you on the free, then you will likely have to spendmoney on a lawyer, and that may entail several thousand dollars to file suit and have a court address this.

Odometer reading for a used car purchase

Answered 5 years and 7 months ago by attorney J. Allen Fiorletta   |   1 Answer
Small claims court may be your best bet, depending on how much the car cost. The limit for small claims is $6,000.00. Otherwise, you may also have a claim for breach of contract/fraud in the inducement. This basically means that you were induced to enter into the agreement based upon lies or misrepresentations of the seller. There is also the possibility that the seller will take the vehicle back in order to avoid being sued.... Read More

I have an issue with arrons rent to own

Answered 5 years and 7 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Ok, probably a good bet that the item isn't very good and since its RTO, not a purchase, bring it back and cancel the contract. You wll still need to pay for the time you had it. Otherwise, if its a cheap repair or you have too much invested in it to walk away,  have it fixed and carry on using it. Irs rarelly productive to spend money on legal fees to address such an issue unless the item is very expensive. ... Read More

Post Office

Answered 5 years and 7 months ago by attorney Hon. Max L Rosenberg   |   1 Answer
You may  attempt to sue the United State Postal Service by having your attorney file a lawsuit in federal court. However, you can't really sue them for a lost item as  The Post Office enjoys special legal protections as a government agency, unlike its compettitors. The 1946 Federal Tort Claims Act (FTCA) protects the USPS from being sued for “[a]ny claim arising out of the loss, miscarriage, or negligent transmission of letters or postal matter.”   Sorry you do not have a case. ... Its unlikely that the amount at issue is worth a law suit over so the options are limited. Most places are providing credits or extended contracts and not refunds. Bear in mind you are expecting people who have not had actual income for 4 months to refund you and others with money they likely don't have so there is some level of practicality you will have to contend with.... The problem with such a case, is that it won't be viewed as credible by the pizza place beyond nuisance value as there are no real injuries. If your son is claiming a dental injury, the fact that he had TWO emergency dental issues in the past month or so will also be a huge factor in that consideration. Especially if he has no dental insurance as the will claim this is bogus shakedown to pay for other dental bills or to address pre-exisitng bad dental conditions. He need to make a claim with the local franchise and likely see dentist if there is a claim of tooth damage, and then go from there. IF he can find an injury lawyer willing to take the case on, all the better. ... Read More

What should I do now?

Answered 5 years and 11 months ago by Edward J. Dimon (Unclaimed Profile)   |   1 Answer
You must put all the information in writing and you must provide all the supporting documentation to the dealer and bank and credit agencies so that there is a clear 'paper trail' of what happened and the checks you have written and submitted each month for the proper payment of the correct car. You cannot withhold payment. You must pay each month and note the specific purpose of the payment. We can help you if you need help with the documentation and payments and 'paper trail' and negotiations with the dealer and lender. Please call this morning. Ed Dimon, Esq. 732-797-1600... Read More

This is simply an issue of your willingness to spend money on one lawyer to dispute fees charged by another lawyer hoping that you get a better value as opposed to simply adding more fees to the pile. The fact that one lawyer charged more or less than another is not a standard as here a many variables to be considered. Any lawyer that has experience in legal fee hearings etc. will suffice as long as you are willing to pay accordingly as these are NOT contingent fee cases. That stated, you need to be more attentive in the fiuture about the expenses as any dispite about the amount, if excessive, should have been addressed as the bills accrued not at the end, when the payment comes due. ... If they are false reporting to your credit report and you can show an actual drop in your score as well as other real world consequences,  you may have a Fair Credit Report Act matter. (FCRA) This is a federal law that requires the a correction by the bad reporter after your first contact to them and also allows for actual damages when the reporting is not removed or continues to be wrong and damaging.  There are few lawyers in Connecticut handling FCRA.  I would reccomend Daniel Blinn in Rocky hill, Sergei Lemberg in Stamford, and possibly my office in Stratford.  Good luck. ... Is there legal action I can take against this dealership?

Answered 6 years and 5 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer
If you are in Tennessee and the dealership in NC, then I would let it go. If the daughter does not want it, you will have to decide if you want to buy it or not. However, not worth the time and money you would have to put into it if you want to try to force them to sell you the car. However, advise the bank what has happened and stop payment on the check.... Read More

What steps to I need to take to resolve this matter?

Answered 6 years and 6 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
No idea what steps are needed absent a full review of what you agreed to in writing and what was represented and not delivered. You will likely need to retain a lawyer at some expense to rewiew your contracts and go from there.

You may need to weigh the expense of a hiring a lawyer with the expense of suing for a refund. It will all depend on the value at issue bearing in mind most lawyers charge $300.00 - 500.00 per hour.

"I immediately start crying and shaking sweating" sorry but histrionics is NOT compensible in a legal case, only actual injuries are. Thankfully there were no injuries, but equally the claim value is weak assuming you can establish liability.  You need to notify Walgreens and see what they say about the staple. Generally such cases have little value when they involve household items of things not expected to be found in the food that occur with no credible witnesses. ... Read More
