Yes, you could file such a suit. The strength of your case would depend on the particular facts. You would probably not be able to recover emotional distress damages in this kind of suit. However, you could recover attorney's fees and other expenses involved with repairing or getting rid of the damaged vehicle. ... Read More

I am sorry that you are the victim of personel roller carts in your way. I do not even know what you mean by "personel roller carts". Furthermore, no one should be throwing over you arguments to move baby carriages out of the way. And finally, if people continue to leave roller carts and baby carriages in your way on the bus, you can either ask them to move or you can enter from the back or front doors of the bus to get around it. There are no laws to protect you from people bringing their carts on the bus and accidently getting in your way. Good luck.... Read More

You absolutely can hire an attorney but it may not be worth it depending on what the stakes are. You should look for an attorney with a good handle on Fair Debt Collection Practices Act (FDCPA) as well as CCPA for Connecticut creditor law. There are not a lot of consumer attorneys out there. Dan Blinn in Rocky Hill, Sergei Lemberg in Stamford, and my firm in Stratford have the type of background that you likely need. Good luck. I also called you twice but you left a wrong number. I think debt negotiation will likely be a better avenue for you and yield better results.... Read More

Once you file bankruptcy, the garnishment will stop. If this is your only debt, I would recommend trying to undo the judgment (if it was a default judgment) and then settling with a payment plan.

You need to find out what the $980.00 is for specifically. If its clear you dont ow it you might have a collections abuse case. If you do or its debatable. then you have a contract/landlord tenant case and it may be more efficient to pay the money and clear the credit but you can sue to dispute claim in an effort to have them remove it as part of a settlement. ... Most personal injury attorneys will do this type of case on a contigency. The upside is that an attorney could negotiate more money for the settlement. The downside is that you would probably have to pay the attorney 33% of the settlement money.

You should definitely file a case, and respond to the police that the work was shoddy and what happened. Intentionally bouncing a check is a crime, but I am surprised the police are involved. If the payment was procured by fraud, that is a defense.

I'm sorry to hear that you're having to deal such a frustrating situation. To answer your question, your situation falls a little into both categories. As I can only speak as to the facts I have here, it sounds like you may have a claim based on Florida Motor Vehicle Repair Act (see FL Statutes, Chapter 559, Part IX). You may also have a claim under Florida Deceptive and Unfair Trade Practices Act. Most civil litigation attorneys should be able to provide you some consultation in the area and perhaps find that you do have a claim. I would advise seeking out a consultation so that you can discuss the details in a confidential environment and get all of your options.... Read More
