My lawyer hasnt replyed to me in 15 weeks. All we have let to do from my divorce is the QDRO. Does it take this long to get the paperwork to sign.

Answered 9 years and 3 months ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
It is not completely clear what is needed from your lawyer, but it is certainly NOT normal to take that long or to ignore a client for that long. Perhaps you could contact the QDRO company and see if they have all they need. Maybe you no longer need anything from the lawyer. Good Luck.

How do I get divorced without his signature on the judgement of divorce?

Answered 9 years and 4 months ago by Michael B. Dungan (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
You should be able to get the judge to enter a default judgment, either for his failure to file an answer or to appear in court. The other party not signing or not appearing in court never prevented a divorce in Michigan before.

I am from AL

Answered 9 years and 6 months ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
It is not a simple question. You will have every opportunity to convince the Court that you should be permitted to move back to Alabama if that will be best for you. However, assuming he will oppose this move, he may win, too. It depends upon all of the circumstances, and you will need a good attorney to advise and counsel  you. Good Luck.... Read More

If you leave the state, you will have to wait 6 months before filing there and hope he does not file here in the meantime. If he does, the Michigan court will handle the matter. If you move in Michigan and are in a new county for at least 10 days, you can file there. Good Luck.

If I worked for 35+ years, married for 16 years and my pension will be approximately $30,000. How much will my husband receive in a divorce?

Answered 9 years and 7 months ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
There are no clear answers to this, but, generally, all of your marital assets and his will probably be divided in half. This will likely include 16/35 of your pension. Hire a good lawyer to get more specific and better advice. Good luck.

If you inherit money while married do you split in in a divorce ?

Answered 9 years and 10 months ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
This is not a yes or no question. If the inheritance is kept separate by the spouse who inherits it (not commingled with marital funds, like in a joint bank account), they have a decent argument NOT to split it, especially if it was inherited around the time of the divorce. If commingled, it is likely to be split. Depends on a lot of things, including how large the inheritance was and how many other assets there are. Good Luck.... Read More
