It depends and were you injured? There are a lot of factors, recoveries and the story to be told that determine liability and value. Also, insurance companies will determine whether it is a person "making their own case," a mill's form letter or a detailed demand package that is the determining factor of an offer. And then is that offer suitable? Essentially, insurance carriers try to negotiate every dollar they can, because every $100 means millions in the end to the Board of Directors. And their lawyers are, respectfully, good at getting one over on novice lawyers and novice victims- you would be basically both. Even in soft tissue injuries, those tissues stretch and scar, or cause corresponding pressure on nerves in the spinal cord, leaving behind permanent problems for some. I have had clients need surgeries years later because of a bulging disk and have their entire world collapse for what seemed inconsequential at the time. Insurance companies want you to settle as soon as possible and treat as little as possible. Attorneys matter. They change their gameplan when a lawyer is involved. For that reason - and the misinformation by TV lawyers and referral services- is why people should consult lawyers who take the time like on sites like this. Because of the economy, more lawyers are jumping into personal injury and should stick to what they know. I would stop raising all of these minimal issues. Without starting a 5 page debate about "I am just enforcing my rights" thesetype of issues can backfire if you get involved a legitimate legal case to paint you as an opportunistic professional plaintiff, regardless of whether its fair or not. Credit cards are not courts to resolve disputes. Be careful as the reversed charge could cause the mechanic to exercise mechanics lien on your car. That’s awful – very sorry that happened to you.  Sounds like you’re getting a pretty solid run-around.  Get an appointment with a litigation attorney to discuss the matter in detail.  Take whatever proof you have of the claim and all of the correspondence you have from the company/distributor.  The company’s insurance carrier may or may not choose to pay, but given the run-around you're getting, it looks like to get any type of recovery you’re going to need legal representation.  Best of luck.... A personal injury case requires both negligence and damages. Unless you actually ate the food, there is zero claim I can think of (outside of getting your money back). If you ate the food, the question is whether you got sick. Obviously the worse the injury the more compensation you should be entitled to. If you ate the food and did not get sick, I presume you may(?) be entitled to some nominal (very minimal) damages, but the cost and time of bringing such a claim makes no economic sense for a lawyer to handle. In addition to all this you would need to prove negligence. That may not be too hard in the case of a full size bug, but it is an element nonetheless.
