H-1B Transfer Question

Answered 5 months ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
There is new guidance on the USCIS website section on H-1B’s that spells out the $100,000 fee only being applicable to new petitions filed on or after September 21, 2025. Persons and companies doing H-1B transfers where the initial H-1B petitions were filed before September 21, 2025, are not subject to the fee. I would recommend you consult with a personal injury lawyer in your state that handles work comp and/or slip and fall cases. If you were on the job, you might be limited to work comp. However, if there was negligence on the part of a third party that created an unnatural accumulation of ice, you could possibly have a case. Laws vary greatly by state for premises liability, so it would be best to consult with a lawyer in your area. Hernia revision repair

Answered a year and a month ago by attorney Hon. Max L Rosenberg   |   1 Answer   |  Legal Topics: Medical Malpractice
If something occurred during the first procedure that was outside the standard course of care, the health care provider may have liability.  You should make an appointment to speak with a medical malpractice attorney. Moreover you would also need another doctor in the same or similar field ready and willing to document that the original doctor made a serious mistake that resulted in your need for a revision.  Call us with any questions.... I receive food stamp and Medicaid/ can I file for my spouse

Answered a year and 8 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Taxation
Hello, if you sponsor your boyfriend, after marriage, and you live under one roof, then you would have a household size of five people, which would include you, your husband, his son, and your two children. Based on the USCIS poverty guidelines, you would need to make a taxable income equal or greater to $45,000. Since you're only making a taxable amount of $39,000, then you would probably need a joint sponsor. Secondly, unless you guys live together, I would not recommend filing right now. You should file when you both live under one roof. It is a huge red flag for USCIS to review an application where the parties do not live together. Finally, I reccomend that you engage an attorney to help you. Some of us charge a very affordable flat fee to handle the case from beginning to end. Counsel in any state can represent you. ... Can you get married during J1 grace period and apply for AOS without consequences?

Answered a year and 9 months ago by attorney Lelia Adams   |   1 Answer   |  Legal Topics: Immigration
Some J-1 individuals maybe required to spend  two year in their home country once done with the program. You said your fiancee is from Germany, he unfortuantely will need to fufil the two year stay in his home country. Generally U.S. Citizen spouses who are or were on J-1 visas need to fulfil the two years if their country is amongst the countries with this requirement. Your fiancee/future husband can apply for a waiver, it is not guaranteed but worth a try. I strongly recommend you retain an attorney to assist you with the process; start with have a detailed strategy session with an attorney.... Read More

Answered 2 years ago by attorney Mr. Justin Heideman   |   1 Answer   |  Legal Topics: Real Estate
It is likely that you have obtained an easement in this use.  We would need additional information to really understand the nuances of the case, but it does seem likely from this brief description that you could prevail. The one challenge a case like this generates that you should know upfront is that the cost of this type of case can be daunting.  It is wise to have that conversation at the outset of the case to determine the cost benefit analysis.... More information  is needed.   Generally, a will needs to be submitted to probate court so that the validity of the will can be determined.    Probate court also requires notice be sent to the various hiers and benificaries of the decedent.   In the probate process, the benificiars are required to have notice as to the contents of the will.   Further, cetain assests such as jointly owned property, bank accounts, etc. may pass out side of a will.   Under certain circumstances, if the probate process is not intiated in a timely fashion, intrested parties may be able to intiate the estate adminstration process. The general rule is that if a foreign national enters the United States on a temporary visa and marries a US citizen within 90 days of arrival, there is a presumption that the immigrant concealed his intent upon entry. You could always get married before the 90 days, but your petition for a green card will receive stricter scrutiny. I suggest that you work with counsel to handle your case from start to finish so that the process goes smoothly.
