OK, so what was the name of the casino? This is important because if it was on tribal reservation property, then those casinos have immunity from personal injury lawsuits. However, if it was a private casino, for example like Harrah's or MGM, then you may pursue a claim. Also what were the extent of your injuries? ... Read More

I am an author and need to know my legal rights

Answered a year and 5 months ago by attorney Mr. Nickolas Spradlin   |   1 Answer   |  Legal Topics: Copyrights
If you’re unsatisfied with a publisher you paid for services and they are refusing to return your money or release the copyright to your work, you can take the following steps: 1. Review the Contract With an Attorney: Carefully review the contract or agreement you signed with the publisher. Look for any clauses related to refunds, copyright ownership, and termination. Pay close attention to the rights you granted to the publisher and whether there are conditions for terminating the agreement. 2. Check for Copyright Ownership Clauses in the Agreement with the Help of an Attorney: If the agreement states that the copyright remains with you or is automatically transferred to you upon termination, you may have a strong case for reclaiming it. If the contract does not specify copyright transfer, you may argue that the copyright should revert to you since you are the original creator. 3. Send a Demand Letter: Have attorney draft a demand letter requesting a refund or return of your copyright. The attorney can outline your grievances, specify the contractual issues, and set a deadline for resolution. State clearly what you want from them, whether it's a refund or a copyright transfer. Be specific about the contract terms that support your demands. 4. File a Complaint with Consumer Protection Agencies: If the publisher fails to respond, consider filing a complaint with the Better Business Bureau (BBB) or the consumer protection division of your state’s Attorney General’s office. You can also file a complaint with the Authors Guild or Writers’ Union if the publisher is affiliated with any such professional organization. 5. Consider Small Claims Court: If the amount you paid the publisher is within the limits for small claims court in your jurisdiction, you can hire and attorney to file a case to recover your payment. Small claims court can be a cost-effective way to handle disputes with the help of a lawyer. 6. Consult an Intellectual Property or Contract Attorney: If your copyright is still in question or if the publisher is holding your work hostage, consult an intellectual property (IP) attorney or contract attorney. An attorney can help negotiate directly with the publisher and assess the strength of your claim to copyright ownership. ... Read More

There is no enough information to determine how fees should work.  Do you if suit was filed? Do you know what the expenses are.  All those issues need to be addressed before an answer or advice can be given.   Your best option is to call your attorneya nd make an appointment to come into the office and see the breakdown of all things they claim need to be paid and have it explained to you.     ... Can an investor close down a business he does not own

Answered 2 years and 4 months ago by Andrew M. Jaffe (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Business Law
The investor's rights are going to be defined by your contracts for his investment (even an email thread could be a contract.) If you do not have a contract, look up the business laws in your state to see what the law says about an investor's rights.  I doubt he can dip into your bank accounts or close down the business.  ... To make a claim you have to prove fault.  If the second vehicle was pushed into you, it is unlikley that you can make any claim against them.  You claims are 1: against the at fault party and 2: if the at fault party is uninsured or underinsured for your damages then agaist your own UIM insurance carrier if you have that type of coverage.    You need to reach out to an attorney in your area that handles these type of claims to see what is your best recovery avenue.    I wish you the best of luck . \... Initially in answering your question, please note that filing for your Ukrainian fiancée would not cover her mother’s situation as she would not be included in such a case. Therefore, to get them both in, it would likely be best for you to financially sponsor them both to come to the US. The number of individuals who can be sponsored is only 100,000, however, and I do not know where your sponsorship would wind up in the line. The program is called “Uniting for Ukraine” and a newspaper article on June 6 said that more than 40,000 applications had already been received Otherwise, through traditional ways of immigration, you would sponsor your fiancée and she would only be able to sponsor her mother when she attains US citizenship.  Between sponsoring under fiancee as opposed to immigrant visa, fiancee sponsorship is usually a few months faster.  Due to the limitations of the Lawyers.com Forums, Alan Lee & Arthur Lee, Esqs.’ (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Just because the former owner wants the car back does not mean that you have any obligation to give it back.  If you can prove that you have a contract to purchase the car in exchange for making the remaining payments as they come due, a court will order that you keep the car.  That being said, if you have no written contract, it may be difficult and possibly impossible for you to prove your claim, and you have to decide how much it is worth to you, in term so both money and hassle, to try to keep the car in court.... If an account has been charged off can you expect a garnishment

Answered 4 years and 6 months ago by William Eugene Maddox, Jr. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Bankruptcy
I'm not sure what you mean by bad bankruptcy, but I presume you mean it was dismissed.  "Charge off" means that the credit grantor wrote your account off of their receivables as a loss, and it is closed to future charges. When an account displays a status of "charge off" it means the account is closed to future use, although the debt is still owed.  So, yes, they can still get a judgment if the statute of limitations has not run out, they can still renew their judgment if they received one already, and they can garnish your wages or levy your bank account. ... What are you seeking here?  If you just want the picture taken down, you may want to consider hiring a lawyer to send a Cease-and-Desist letter.  While a cease-and-desist letter has little legal impact, the lawyer's letterhead gets the recipient’s attention.     This is a relatively inexpensive way to put the person on notice that you are not going to let these actions continue and that you are serious about pursuing your legal remedies.  It also tells the person that they could get in legal hot water which will cost them a lot of legal fees if nothing else.  This will often convince them to stop their evil ways.   If you are thinking you will get them to pay you a royalty, I doubt that will happen. Please feel free to contact me.  There is no charge for this initial consultation and it is covered by attorney/client privilege.  ... Read More
