Can I file a lien on my neighbor's property?

Answered a year and 4 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Maybe - maybe not. While you view that you gave prior notice, the facts suggest that you pointed out specific tree and they removed the trees you pointed out. Unless you also pointed out that specific tree, it might show that neither you nor they were aware of any poor condition of the tree at issue. You would need a written opinion from a qualified arborist to take the position that they knew of the condition of the specific tree that fell and were negligent. The fact that a tree falls over in a hurricane is typically and "act of God" for no one is responsible. You might be better off making a homeowners insurance claim. ... Read More

Can I sue my local restaurant for this?

Answered a year and 6 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Yes, but the damages are questionable, as ice would not likely "burn your skin" or affect your throat and is not likely worth the effort. This also raises potentially controversial issues such as why you would "fall asleep" in a restaurant booth where pouring water on you did nothing to wake you. You can contact law enforcement if you like as this may about to a legal battery and there might be security video of the event. ... Read More

NO way to tell from a one-sided internet blurb. You will likely need to retain a lawyer to review the specific details, including the allegations of the employer or complainant. That said, that "someone asked how you knew" about some medical event with an employee, suggests that you  were discussing what may have been protected information with someone else. Use the find a lawyer feature to locate a suitable lawyer in your area for that purpose. ... Read More

If the case meets economic feasibility, there may be ways to preserve your benefits. It would be wise to preserve photos of the scene, your body and store away your footwear. Seek appropriate medical care. You should contact a Personal Injury Attorney as soon as possible to review all facts and circumstances-especially details regarding what caused your fall and hopefully obtain representation. If there is a dangerous condition that caused your fall, resulting in a significant injury, a Personal Injury attorney can investigate this matter. A Personal Injury attorney experienced in handling Slip/Trip and Fall cases can guide and advise you and evaluate your claim. However, if you are interested in consulting with one of us, you will have to reach out, as attorneys are unable to directly solicit on this forum. Do not delay so a notification to preserve any video evidence may be sent timely and not to potentially prejudice your rights. Loren L. Gold, Esq.... Read More

Uncortunately, you won't do much simply because you don't have the practical means to do so whether your finanical situation, housing situation or physical situtation. Your best bet is to go find a water pump cover at a junkyard and have it installed elsewhere.

You most likely have a case. The gentleman you spoke with could provide testimony that would establish negligence on the part of the resort. You should retain an attorney here in Orlando for contingency fee representation which means you pay nothing unless you win. Did you obtain the gentleman's contact information? It is important to retain counsel quickly so that a certified letter to preserve video evidence can be sent out before said evidence is erased. Stephen Black, Esq. You should reach out to a personal injury attorney here in Florida for possible contingency fee representation, which means you pay nothing unless you win. If this happened in a jail/prison, there are shorter periods of time in which your son has to bring his claim or else it will be time barred. You should explore all the facts of this case with an attorney to determine when that period of time expires. Stephen Black, Esq.  407-581-2581... Read More

Not sure what the question is.  That stated, if the condo rules do not allow a washingmachine in the unit, then the starting point is that the answer is NO. He obviously claims he DID examine those items if he reported them working fine. Not sure what the question is - but if yo are looking to sue the inspector you will need to prove they were broken when he looked them and didn't note the defect. Its a pretty good bet that the inspection did not include the appliances, as most don't, unless specifically requested and charged for same.
