Land contract

This looks very much like an illegal lockout. The prior owner looks like he broke the law and may be liable for triple damages. This could be a very good case against them.   They appear to have violated the spirit and order of the court. VERY bad for them. To prevail, you will almost certainly need a lawyer. my email is gb@borman.net if you wish to be in touch.... Read More

My I use garage as dog shelter? No primary structure

Answered 2 years and 7 months ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Real Estate
If you are not using it as a residence, then I cannot see how it can be claimed you are using it as a residence. You have an absolute right to use the property. Just as you can store your property in a garage, your dogs are your property. You will not be able to keep the beds there. The alternative is install what is needed, probably just a bathroom, and file for a certificate of occupancy as a residence.  ... Read More

How do I get my name on a warranty deed after probate is cloused

Answered 2 years and 7 months ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Real Estate
Depending on how the house was deeded to you will determine what your right course of action is. If the house was deeded to you 'as husband and wife,' there is nothing you need to do. When he died you automatically became sole owner. If you go to sell or mortgage the house, all you need to do is present a copy of the death certificate. So if you bought with a warranty deed, you can give a warranty deed. Depending on the nature of your title and your deed, you might not have an issue. If he bought it before your marriage, that could be an issue for you. You would be well served by having an attorney review your deed and check title. Best to take care of problems before try to do something and find out you can't or you need months to fix the issues. Best of luck to you.... Read More

The fact that they moved the camera to be able to see into your house is deeply troubling. Have you documented this with police reports or any notices? Is the neighbor a renter or owner? While they have an absolute right to film anything affecting their home, NOTHING gives them the right to spy on you. Either way, an action for trespass or nuisance could be made against them but the police are the first line of defense in dealing with this. please answer the questions above so we can see the next steps forward.  ... First, did you get insurance on the move? Second, if you did, demand to make a claim (do it fast, they often are time limited). If there wasn't insurance, you can make a claim against them. If they forged signatures, that is a very big thing it all but proves guilt in the case. I am not the right lawyer for this kind of matter, if you do not have a lawyer, I can help you find one.... Can I fight a neighbor to take their tree down

The neighbor is responsible for the tree doing damage to your property.  If they refuse to correct the issue, you would have to sue to get them to take the tree down.

Based on the information that you have provided, it is my opinion 99.99% that this person is lying to you and trying to scam you. I would end all contact with this person by blocking their emails and all other means of communication. If they do contact you I would inform them that you will contact law enforcement if they contact you again. It is my opinion that you have nothing to worry about. Enjoy your weekend.... Read More

Why wonโ€™t a lawyer take my case ?

Answered 2 years and 8 months ago by attorney Dale Gribow   |   1 Answer
My guess is that a lawyer would take the case if you paid on an hourly for the lawyer's time. Many potential clients want lawyers to take everything on a contingency and that is not realistic. Lawyers would go broke taking all cases on a contingency. Many cases will be hard to prove and costly to bring.... Read More

I strongly suggest you contact legal aid. If there are other family members who you can stay with and be safe, it is recommended. I do not doubt your need to get out of where you are but your personal safety is what matters most. From a practical standpoint, getting full time work while under 16 is difficult. Lastly, no matter what, make sure you graduate High School, without it, you will be very limited in your abililty to get the jobs you want. Best of luck to you and be safe!... Read More

what can an HOA do to recover unpaid dues?

Answered 2 years and 8 months ago by attorney Gilbert Borman   |   1 Answer
You should hire an attorney to begin collections against non-paying members. In extreme cases, you can even foreclose on the property. It begins with sending proper notices. In most cases the HOA Agreement provides for the homeowner to have to pay the legal fees of the HOA in collecting or foreclosing on the property. If you are located in SE Michigan, feel free to be in touch. 248-353-5555... Read More
