How do I get a felony expunged.

Answered 10 years ago by James T. Hanvik (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
Minnesota's expungement process has changed considerably in recent years.  It is now such a common process (with much better guidelines on what the courts can and can't do) that it is contemplated that most people will do this on their own.  If you go to the Minnesota courts web page you should be able to find expungement forms.  Some are specific to individual counties, such as Hennepin County District Court.  It may be different if the underlying conviction was in federal court.  If you have questions, you can feel free to call us at 952/285-1811.... Start by getting a lawyer retained to represent you. Your lawyer will advise you about how best to handle the situation. The warrant and affidavit should be reviewed to make sure they were valid. And the evidence must be reviewed to see if they can really prove a sale. It sounds like perhaps you think they cannot. Feel free to give me a call if you have additional questions.... Read More

You have rights here. You are an innocent owner. You have the right to file a petition with the court where a judge would determine whether you are truly an innocent owner. If you are found to be an innocent owner, the vehicle should be returned to you at low or minimal cost. Another option is sending a document to the prosecutor called a petition for mitigation. I would recommend getting some help from a lawyer. You don't want to be talking directly with the cops yourself.... Read More

You will be charged with a gross misdemeanor crime. It is punishable by up to a year in jail and a $3,000 fine. If it's a first offense, you won't get all that. But this is a very serious matter and you should hire a lawyer. Priority #1 should be your long-term criminal record.

I am a nanny and yesterday I told my employer I was pregnant and today she's trying to dock my pay and work more hours and adding chores

Answered 10 years and a month ago by Thomas Alan Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Labor and Employment
Discrimination based on pregnancy would be considered sex discrimination under Minnesota law. Whether the actions the employer has taken could be considered unlawful discrimination will depend in part on whether they are adverse to you and whether they are based on your pregnancy. You should consult with an employment law attorney to discuss this in more detail.... Read More

If the buyer was aware of the forgery, you may be able to have the transaction rescinded and get the car back.  If the buyer was an innocent purchaser, then you will probably be limited to seeking damages from the forger for the value of your part ownership of the car which you lost.  You could also make a criminal complaint to the police, as forger is a crime as well as a tort.... Sorry to say, but it's extremely unlikely that the case would be dropped completely. What you should consider doing is to retain an attorney in the state where the case occurred - sounds like that's Minnesota - where I am too. Your attorney can try to get you a chance to appear in court voluntarily, or make plans for you to turn yourself in and secure your release as quickly as possible. The key is to have your attorney attempt to make arrangements in advance. That way you know what you're walking into before you even think about coming back into Minnesota. With the time that has passed, perhaps the state's case against you isn't as strong. Memories fade. Cops retire. Things can change significantly over five years.... Read More

can I be fired for needing surgery during probationary employment?

Answered 10 years and 2 months ago by Thomas Alan Jacobson (Unclaimed Profile)   |   1 Answer
It's possible that the employer may be required to give you the time off as an accommodation for a disability. However, that depends on a number of factors, such as what your condition is and how many people work for the employer.

If I leave my current employer with less than a two week notice can they refuse to pay out my vacation pay balance?

Answered 10 years and 2 months ago by Thomas Alan Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Labor and Employment
Under Minnesota law, whether or not an employee has a right to be paid for accrued but unused vacation time depends on the employer's policies or any agreements between the employer and the employee. So, in order to answer this, we would need to know what those policies say and/or whether there were any agreements between you and T-mobile relating to this issue.... Read More

If police got a tip that guns are in the house, do they have the right to enter?

Answered 10 years and 2 months ago by attorney Samuel J. Edmunds   |   1 Answer   |  Legal Topics: Criminal Law
The police would normally use the "tip" to establish probable cause, which will help them obtain a search warrant. Subject to a few exceptions, police can't just barge in without a warrant. If you are facing criminal charges, retain a lawyer right away.

Immigration question

Answered 10 years and 2 months ago by Wendy Barlow (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
The answer will depend upon whether your mother is a United Stares citizen or lawful permanent resident. Your marriage would make you ineligible for an immigrant visa through your mother if she is only a lawful permanent resident unless she naturalized before you married.

I was arrested for dwi my implied consent and Reason to detain was sent to snowmobile club before I was convicted is this illegal

Answered 10 years and 2 months ago by James T. Hanvik (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
The fact of the arrest is a matter of public record.  (Immediately afterward, you probably received a number of solicitations in the mail from lawyers asking that you hire them, a practice that I'm not a fan of.)  If anything else was said to your snowmobile club that was untrue, it could rise to the level of defamation, although sometimes making an issue of something may publicize it rather than suppress it. ... My mom wants to petition my sister

Answered 10 years and 2 months ago by Wendy Barlow (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
I do not understand why your mother would lie about not having children. It will likely be difficult for her to petition for her daughter given she claimed no children. She will likely need to thoroughly establish her daughter is in fact her daughter. In addition, she could face inquiries from immigration for misrepresenting herself. This is a serious matter. She needs to discuss what happened in more detail with an attorney.... Read More

What constitutes possession of drugs?

Answered 10 years and 3 months ago by attorney Samuel J. Edmunds   |   1 Answer   |  Legal Topics: Criminal Law
It sounds like your daughter admitted to possessing the pills. She wasn't saying that somebody else put the pills into her mouth, was she? Combine that with another witness saying that she gave the pill to your daughter, this could be enough proof that she in fact possessed the pills prior to ingesting them. This could be a serious matter for your daughter. I would recommend getting an attorney retained to represent her right away.... Read More
