The Supreme Court ruled in 1872 in the case of Taylor v. Taintor, 83 U.S. 366, that a bailbondsman has sweeping rights to recover the bonded person. These rights include breaking into a house where the bonded person may be hiding if they have a easonable belief that the bonded person is in the house.   Other attorneys may have different opinions as to the merit of your claim. If you wish to go forward I suggest you contact one.   Gary Kollin 954-723-9999  ... Read More

What should I do if I was denied housing because of my previous charges?

Answered 10 years and 2 months ago by Mr. Gary Kollin (Unclaimed Profile)   |   1 Answer
Rental companies/landlords generally use a private investigator who uses a database to search the applicant's records. Those records will show all arrests. As long as the records exist either in the database or the courthouse records they are available for viewing and utilization. You are entitled to certain information from the landlord based on the method by which the landlord obtained the information Often times you can bring a copy of the dismissal to the landlord and resolve the problem. However, the landlords usually want an understanding as to why the case was dismissed. For example, if a drug charge was dismissed because of an illegal search, but the applicant still had the drugs, then the landlord would ususally reject the dismissal. The first step to do is get your record expunged or sealed. If the case was dismissed by the prosecutor, then you can get the record expunged provided you otherwise qualify. One disqualification would be that you were previously adjudicated for any criminal charge anywhere including a criminal traffic offense. Once you get your record expunged or sealed, there are methods to have the information from the databases.   I handle records sealing and expungement throughout the statement as well as having the information removed from the databases.   Gary Kollin 954-723-9999 garykollingarykollinlaw.com... An attorney could assist but this is a matter for paying the attorney's time. I doubt any attorney would take the case con a contingency basis without further investigation and I dont believe any attorney would conduct that investigationwihtout charge.   I  suggest either you retain an attorney or you contact the Office of the Inspector General of the Department of Corrections in Tallahassee and report the problem.  I am sure by contacting the department you would be able to obain the correct phone number.... Restoration of Civil Rights

Answered 11 years and 4 months ago by J Alistair McKenzie (Unclaimed Profile)   |   1 Answer
When a person is convicted of a felony, they lose many of their rights.  It is then left to each state to determine, if, when, and how a person can have certain rights restored.  Unfortunately, in the State of Florida we have one of the worst rights restoration programs currently in place.  So, in short to answer your question, the rights restoration process is not a violation of your civil rights, though it is a terrible and drawn out program in Florida.  ...
