What will happen if his ex wife does not appear in court?

Answered 9 years and 2 months ago by attorney Lori Nevias   |   1 Answer
Pet custody cases are increasing in number, and courts take them seriously. While courts consider many factors, if your husband can prove that he was the main caretaker for the dogs and paid all the vet bills, he will likely win, regardless of whether his ex wife shows up in court. However, I'm not sure that you're in the right court. The only court that sends notification to the party you're suing is small claims court, and small claims court doesn't have jurisdication over the kind of case you need to file. That could be why the ex is ignoring him- she might have seen a lawyer who told her he was in the wrong court.  ... Read More

You have no right to make the  private school take her. It is the schools choice to take her or not.  The school is not denying your daughter an education because you can always send her to a public school.

If my husband, soon to be "ex", sends me offensive pornographic texts, is that against the law in TN?

Not sure but it would at least constitute harrassment. Contact the police department and see what it says. This at least might scare him.

Who wants to win a slander suit for me?

Answered 9 years and 4 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer
In Tennessee, the tort of defamation encompasses both libel and slander. Libel is the printed word while slander is the speaking of base and defamatory words which tend to prejudice another in his reputation, office, trade, business, or means of livelihood. To establish a prima facie case of defamation, a plaintiff must prove that: (1) a party published (written or spoken)  a statement; (2) with knowledge that the statement was false and defaming to the other; or (3) with reckless disregard for the truth of the statement or with negligence in failing to ascertain the truth of the statement.... does a school have the right to search a students personal email

Answered 9 years and 4 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer
You were not specific about if the computer was provided by the school, if this was a personal computer that you bought to school or was your computer at home  when the emails were pulled up by the "tech center"? Understand that when you post on social media, then this is going public for the whole world to see. There is not a lot of information here to give a firm answer. Whether the father is the biological father based upon paternity is one issue that may mean he is off the hook for further child support. However, if he acted as the father and accepted responsibility as the father regardless of whether he was the biological father or not also makes a difference. However, if he insisted on being tested from the beginning and never held himself forth as the father would mean he is no longer going to be required to pay child support. As to what he might have already paid, I think you might want to check with welfare. They would have been the ones receiving the payments.... Read More
