Having dealt with this issue many times, the standard answer is "not gonna happen". He will have to make the choice of either he or brother paying what is owed, turning brother in for ID theft and getting off credit, or do nothing an it stays on credit report until it expires. Its important to understand that the bad brother esentially stole from the creditor so they will be unlikely to just let that pass at thier expense because it inconveniences your BF. There is something missing from these facts, as the finance company lives and breathes to collect money not repo cars. If you are "trying" to contact them to pay the debt owed, they are usually hyper recpetive to this and the vast majority of issues that arise here are that theget TOO aggresive trying to collect the money owed. You may want to hire a lawyer to correspond with them to get answers as they often will take such inquiry more seriously or refer to thier legal counsel. Harassment

Answered 11 years and 9 months ago by N James Turner (Unclaimed Profile)   |   1 Answer
What is the name of the debt collector?       The Fair Debt Collection Practices Act regulates how debt collectors must behave when attempting to collect debts.  If the debt collector’s actions are violating the law, not only can you stop the harassment; you will also recover damages from the violators.  Better yet, Congress forces the violators to pay your attorney fees. You can try, but since you are involved in litigation, you are also exposed to them simply winning in court and obtainining a judgment against you. Its also important to point out that none of the issues you raised act as legal defenses to the debt you owe and most of them represent your voluntary decision to disregard your obligations to address the issues of other people. While it is clearly your right to make those decisions, it is equally the right of the debt collectors to ask the court to hold your responsible for your promises and obigations to them. Since you are only working 30 hours a week and the debt is only $2,800.00 you shoudl also contemplate getting a second job to add to your income to pay this debt or others you may have accrued.
