repair shop

Answered 11 years and 4 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Unfortunately, what you describe is not an inherent legal problem. At least not yet. Stating that "the car ran great" except for it was leaking oil AND transmission fluid, is the OPPOSITE of running great. If you dont trust them, you can pay for the repairs you authorized and have car towed elsewhere to get second opinion on computer. YOu could also hire a lawyer to intervene for you, as this will often scare scammers out of scam mode, but youhave to weigh the expense added. Can you charge interest on a debt purchased?

Answered 11 years and 5 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Depends on TX law. As a general rule though, anytime you owe someone money as part of a loan, they will be charging interest. Depending on how the loan was sold, changing WHO you owe does little toaffect HOW MUCH you owe.

You may need to retain a lawyer to sort this out before it gets out of hand. The old "some guy on the phone" scam is not a defense to the actual creditor if they dont get paid. You also need to check your purchase agreement as it typically spell out where payment is to be made. Really? This just reeks of convenient dipsute to avoid some obligation. Let me guess, your daughter has not defaulted and they want you to pay? Problem here is the innocent 20 y/o claim is dispelled by fathers presence and presumably you raised her to know that forging your signature is wrong. If you want to claim that she forged your signature without your permission, assuming its true, then you would likely need to report the forgery and fraud to local law enforcment and present this information to the lender. While they may let your out of the contract, it will likely be at the expense of criminal prosecution for your daughter. This is classic cant have cake and eat it too situation. I am fairly confident that your did not buy a hopped up Ford car from Ford directly, as opposed to "at a Ford dealer", as manufacturers dont sell non production cars that blow up the engine to do over pressure, excessive torque on the tranmission/transaxle, etc. and don't provide third party warranties for such things. If you  It is a well known that if you mod an engine or performance outside of factory spec, whether it being a chip/computer replacement, altering air/fuel ratio, running NOS or race fuel, etc, its considered abuse of the engine and voids factory warranty. Absent an actual manufacturer warranty, that covers the mods or they are factory mods, you are likely out of luck ... Read More
