I think I'm being scammed (I'm a seller)

Answered 9 years and a month ago by attorney Sharon M. Siegel   |   1 Answer
You are being scammed.  The closing of the bank account is the problem.  The bank should tell you why it was closed.  Moreover, they cannot just reverse a transfer.  Ask to speak to the bank manager.

Do I have a case for false advertisement?

Answered 9 years and a month ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Not likely as there are often changes and programming issues with various manufactuers. While I am sure you would be happy with the extra device at the door opener companies expense, they may oppose this as much a you might equally be happy with carmanufactuer making thier car compliant at thier expense. You may have a Mag-Moss warranty issue or a false advertisement claim to pursue but this will all revolve around the terms and conditions of the sale and warranty documents, ut such cases are not inexpensive and you may have to pay legal fees up front and seek reimbursment later. You may just need to return the item for a refund if possible or simply by the additional component. ... Read More

Options to get out of a golf membership

Answered 9 years and a month ago by attorney Sharon M. Siegel   |   1 Answer
It depends on the terms of the agreement.  If you stop paying, you would be sued, and the issues you raise would be defenses.  Ideally, you would write a letter now, terminating your membership for these reasons.

The dealer is likely right. You generally dont get to sign contracts and the back out later because you changed your mind about what you can afford. You do that BEFORE you buy things. If you insist on trying to get out of the deal - you will need to retain a lawyer to handle this and it may not be successful depending on what you signed. ... Read More

There is no case here. As your personal security is an issue YOU need to be more diligent about when or how that information is revealed and the manner in which that occurs. You can try hiring a lawyer to send a letter or possible try to file suit against them here an send a copy of the lawsuit to them or have them served. Practically, you are likely throwing good money after bad unless you want to sue them in Az and try to collect if they are kaput.
