Answered 8 years and 10 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
If this is a first offense, in Wisconsin that is not a crime, and one would not expect it to be reported to the National Crime database. A second or subsequent OWI, however, would almost certainly appear.

How can I get my license back if I just paid the court fines and fees but never did the alcohol school or did any of the probation?

Answered 8 years and 10 months ago by Jeff Fengcheng Yeh (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
You must complete the alcohol program, or you will never get your license back. First thing first. You should hire a lawyer to go to court to recall the warrant. A lawyer can do this without you present if the underlying charge is a misdemeanor, so it is less risky for you. You can never get reinstated into the program as long as you have a warrant.... Based on what you have described, I expect the blood test to be at or near zero. I expect the charges to be dropped. But, they will remain on your criminal record. Sealing these from public view should be attempted. It usually takes 3-8 weeks for the blood test to be completed.

I recently got a DUI, I tried parking and accidentally scratched a car , I don't have a license I was wondering what would be the punishment ?

Answered 8 years and 10 months ago by Ronald L. Freeman (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
You are facing some very serious problems. First, you have a DUI with property damage. Depending on the county that you were charged in you could be facing a potential jail sentence and fines of $1900. Now factor in that you did not have a license and you the DA could seek a jail sentence on that violation as well. The best thing you can do for yourself is to hire an attorney to fight the DUI charge, and for you to try to obtain a driver's license before your court date. Not to mention, that you only have 10 days to request a DMV hearing on your license (which you do not have) will be suspended. ... Read More

Is there a statute of limitation if I got a DUI while visiting in 2005?

Answered 8 years and 10 months ago by Michael B. Dungan (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
The statute of limitations only applies to how long it takes to charge you, if you have an open court file, you were charged so the statute of limitations does not apply. They can bring you to trial anytime they get their hands on you, although the more time passes, the more difficult that could be for the prosecutor. You may want to explore resolving the case with a plea by mail.... Read More
