If you are convicted of a felony and it remains on your record you are prohibited under the federal law from the ownership or possession of any firearm. Depending on your conviction, and other record previous and post, it might be possible for you to have the burglary conviction expunged either presently or in the near future if you are in Michigan. You should confer with an attorney to see what your possible courses of action.... Read More

Will a shoplifting as a minor be removed at 18 and what will happen if I donโ€™t receive something in the mail?

Charges that a person receives in juvenile court are sealed from the public's view. So, if you were charged as a juvenile, the disposition of those cases are sealed. You don't indicate whether the '2nd time in trouble' was a juvenile case or not, so I can't address this issue. But if there is a 2nd offense all you have to do is call the clerk of the court and find out where the case is at this time.... Read More

You need to go to the juvenile court where you were convicted, but even a sealed record may be on the state computer depending if the crime was committed before or after you were 16. Talk to your lawyer again. You may have admitted to a charge which would not be kept on the state computer.

expunging a dui

Answered 12 years ago by attorney Sina Mohajer-Jasbi   |   1 Answer   |  Legal Topics: Expungements
In order to properly answer your question, I would need to know whether your DUI was charged as a misdemeanor or felony. If it was merely a misdemeanor, you can simply fill out a form requesting the court to dismiss your prior conviction, so long as you are not now serving a sentence for any offense, not now on probation for any offense, and are not now charged with committing any offense. However, if you were charged with a felony DUI, then you will need to determine whether it is considered as a “wobbler” offense and reduce the felony charge to a misdemeanor pursuant to CA Penal Code § 17(b). Once it is reduced, then you can proceed to request the dismissal of your prior conviction. I hope this has answered your question. If not, please feel free to contact me and we can discuss this issue in more detail. ... Read More

If you were convicted of retail theft in Missouri, you can't get the conviction expunged. If you were charged and you haven't appeared in court yet, then you can hire an attorney to get the theft charge dismissed or reduced to a lesser offense, such as "Littering."

Is there anything more than bad checks here? It sounds too harsh of approbation for bad checks. You may want to consult a lawyer to see iif your felony can be reduced to a misdemeanor if you are done with your probation.

Not in Missouri. Only convictions can be expunged, not charges. Answered 12 years ago by attorney Steven Fairlie   |   1 Answer   |  Legal Topics: Expungements
Just because you were 302'd does not mean that you can't get relief.  Were you actually committed or is there no paperwork because once you woke up they realized that you did not need to be committed and released you?  Have a lawyer try to obtain the paperwork.  If there is none then you should be able to get it expunged since no one will be able to prove that you were actually committed under the circumstances required by the statute. ... Taking steps to clean up your sister's record will drastically improve her efforts to get a job. Felony convictions really hold you back in that way. Depending on the exact conviction and sentence, there may be several remedies. Consult with a local criminal attorney to discuss reduction of the felony to a misdemeanor, 1203.4 dismissal (expungement) and certificate of rehabilitation to determine what is appropriate in your sister's situation....
