That's true. If you plead guilty, you will be stuck with the conviction on your permanent criminal record. However, you may have certain post-judgment remedies available to you. It just depends on the circumstances of the case. What were you charged with? In what court did you enter the plea? Why did you enter the plea that you entered? ... Read More

Would the felony on the 90โ€™s still show up or does he need to hire an attorney to have them expunged?

Answered 12 years and 2 months ago by Andrea Rogers (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Expungements
In Missouri, there are only 3 types of felonies that can be expunged: passing a bad check, fraudulent use of a debit/credit device, or fraudulently stopping payment on an instrument. If your felony is one of those 3, then you can hire an attorney to petition the court to expunge the felony conviction. If your felony is not one of those 3 types, then you can't get it expunged.... Answered 12 years and 2 months ago by Matthew R. Kober (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Expungements
Expungement in Utah is based on eligibility. Eligibility is based on a number of factors: the two most important factors are the time that has passed since your conviction (and finishing probation) and your total number of offenses in your criminal history (in and outside of Utah). In Utah, you are allowed to have 1 felony, 1 Class A, and 2 Class B's and still be eligible. If you have more than that in any category, you can do what is called a 402 reduction and try to reduce them to a different level. You can also do a 402 reduction in order to reduce the amount of time you have to wait to get an expungement. The waiting period for a felony is 7 years, for a Class A is 5 years, and for a Class B is 4 years. You need to talk to an attorney to understand what you can do.... Read More

Can I get my gun rights back if I have my felony expunged?

In Missouri, only 3 types of felonies are eligible for expungement: passing a bad check, fraudulent use of a debit/credit device, or fraudulently stopping payment on an instrument. If your felony conviction is one of these 3 types and you have no other misdemeanors or felony convictions within 20 years of your original felony conviction, then you can file a petition with the court to expunge your felony conviction. If you were on probation, it's possible that you received an SIS (suspended imposition of sentence), meaning there will be no conviction on your record if you successfully complete probation. If instead you received an SES (suspended execution of sentence), then there will be a conviction on your record.... Read More

If I was to get my felonies expunged, do they still show up in a background check? If so, is it a waste of time to do so?

The government and public agencies will see it. Public will not see it as it is expunged. Depends on what you are trying to do.

I am not sure why you would have the 10 year ban. The 10 year ban applies to domestic violence matters. If this is a domestic violence issue there is no way to terminate that ban until 10 years after your probation ended.

Yes, this conviction will appear on background checks. You must wait 5 years before you can petition the court to have it expunged off of your record. Each employer will handle the conviction differently. Some employers may choose not to hire you based on the conviction, others may still give you a chance. You should be prepared in interviews to address this issue and explain it in a positive way. i.e.... Read More

felony expungement

Answered 12 years and 2 months ago by Mr. Richard Keith Oliver (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Expungements
Unfortunately, you cannot have it expunged or sealed, if you took a conviction for the misdemeanor and did 30 days County time on that. However, you can certainly say on job appplications that you are not a felon. If the case was dropped to a misdemeanor, and you did jail time for that, then you have a  misdemeanor conviction, but no felony. Given what you posted here, you are not a felon.... Read More

Can I have an arrest sealed that happened 17 years ago and do I need to come back to the state where it happened to do it?

Answered 12 years and 3 months ago by Andrea Rogers (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Expungements
It depends on the laws of the state where it occurred. You need to consult a lawyer who practices in the city or county where it happened. Your attorney can tell you whether it's possible to get it sealed. Most likely, if it's possible to get the arrest sealed or expunged, there will be a hearing and you would have to attend the hearing with your attorney. In Missouri, you can not get the record of an arrest expunged (removed) from your criminal record unless you were arrested based on false information and no charges were filed.... Read More
