Highly unlikely.  You would have to prove a constructive firing. This is not a good start to a case if you have to ask this question. However, you mention an employment contract so this is encouraging. In order to properly answer this question, I think you should consult with an attorney that deals with employment law. My partner handles these matters frequently and we would be happy to hear from you, should you require further assistance.... Read More

Who do I file against

Answered 4 years and 8 months ago by attorney Hon. Max L Rosenberg   |   1 Answer
Its possible she did something in probate court.  You might start by checking the probate court for the town they live in.  You could also check the Connecticut judicial website to see if she did anything you are unaware of in civil court.  From your question, however, I would say your best bet is to hire/ consult with an experienced family law attorney. Please contact us if we can be of further assistance. 203-870-6700. Good luck.... Read More

Well it depends on the complexity of your case, and if it is a straightforward case with no extenuating circumstances then it should be pretty reasonable of a fee that a lawyer should charge you. Some of us charge a very affordable flat fee so you should call around and Speak with a lawyer in a free consultation.     ... Read More

If I sign a contract with a closing date assigned is that date binding?

Answered 4 years and 8 months ago by attorney Bruce Robins   |   1 Answer   |  Legal Topics: Real Estate
The contract is not binding on a party until that party has signed.  You do not have to agree to the new date, but neither does the seller have to agree to the date you had proposed.  If you don't accept the new date, you have no agreement.  You should know that in most circumstances, the closing date in the contract is not binding and closing is adjourned at least once, unless that date is explicitly made "time of the essence." (in New York, it oculd be different in Connecticut, but I doubt it).... Read More

In order to answer this question I would need to review the contact and all of its terms. Otherwise, you can sue him for specific performance in superior court (Probably inadvisable)  or to recover your deposit in small claims court.

Stop foreclosure

Answered 4 years and 9 months ago by attorney Hon. Max L Rosenberg   |   1 Answer   |  Legal Topics: Foreclosures
No, that will not stop the foreclosure. You need a payoff number which will include their attorney fees and court costs and other penalties.  Your best bet is to hire or at least consult with Foreclosure Defense counsel.  Make sure you find an experienced foreclosure defense attorney who can possibly get you into mediation and/ or a plan.  You might also consider a Chapter 13 bankruptcy which forces the bank into a payment plan and stops the foreclosure case immediately. My office focuses on both of these areas of law. Please feel free to contact us at 203.870.6700.... Read More

Can I applied for a work permit in usa while on a waiver

Answered 4 years and 9 months ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
I doubt that you can apply for a work permit if entering the US by waiver for six months. I assume that the entry was not for working purposes, and it would likely take USCIS six months plus at its current pace to process an employment authorization application even if you were eligible. Answered 4 years and 9 months ago by attorney Hon. Max L Rosenberg   |   1 Answer   |  Legal Topics: Medical Malpractice
In order for you to have a med mal case you need to be able to show that the opperating doctor went against standard opperating procedure or in some way did not meet the standard of care. You must also show what the reqired standard is and how it was deviated from and that their is a causal connection between the deviation and the injury.  The way you prove this is by getting a sworn statement or testimony or affidavit from another medical professional in a substantialy similar practice.  Please feel free to contact us for more information or assistance 203-870-6700.... Will I be liable for unpaid CT tax of prior business owner?

Answered 4 years and 10 months ago by attorney Bruce Robins   |   1 Answer   |  Legal Topics: Business Law
You state that there are unpaid taxes of the prior business owner.  If that is acccurate, you would probably not be liable for his/her taxes (although you should be careful if you are buying any assets from this person, as it is possible that tax liens have attached to the assets; although you would not technically owe any taxes, you would be buying the assets subject to the liens, and the taxing authority could foreclose).  However, I'm not sure it is accurate.  Are you sure that the taxes are owed by the person from whom you're buying the business and not the business itself?  There is a big difference and if, for example, you are buying a corporation or llc which owes taxes, that entity would still owe the taxes even under new ownership.  Also, even if you are not buying the business entity, but only the assets of the business entity, if you continue on with the same business (same customers, same products/services, same location, etc.) there could theoretically be successor liability for the taxes.... A Will might designate an executor to administer the estate but it cannot designate an agent under a power of attorney.  Both a medical and a durable [financial] power of attorney expire with the person who grants them.  You do not have rights in this situation but your mother does.  If you fear your brother is isolating her, report this to Adult Protective Services.  You may also want to talk with an elder lawyer.  You can find one near your mother on the website of the National Academy of Elder Law Attorneys (www.naela.org).  ... Modafinil is a well-known and well-researched medication that has been approved for medical use in the United States and Europe for two decades.  People need to have a prescription from a doctor. Its categorized as a “Schedule IV” substance by the FDA which specifically states it is generally illegal for anybody other than a DEA-registered importer to import medications for personal use into the country.  You can even be charged with a felony for the simple possession of Modafinil without a valid prescription or other legal causey the Drug Enforcement Administration (DEA).  So have you been charged?
