Exiting a contract - discovered other party sells drugs

Answered 11 years and 2 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Nope, your bare suspicion of illegal activity, or even outright knowledge of it, is not a basis to breach a contract unless it directly related to your work. For example, a website for selling "bath salts"...

Can I receive compensation for lost money and time due to a seller backing out of a signed contract for a home?

Answered 11 years and 2 months ago by W Chase Carpenter (Unclaimed Profile)   |   1 Answer
Although I don't see it in your description, I'm assuming the home was in Florida - and the contract governed by FL law.  I make that assumption because real estate laws can vary greatly state to state.  That said, start with your contract - there may be a section that already spells out what happens when buyer or seller breach the contract.  I would expect that there would be language dictating the ability to receive damages against the seller for a breach.  If the contract is silent, a lot depends on the details, but generally, yes, you should be able to seek damages against the buyer caused as a result of the breach of contract.  Sounds like you may benefit from having your contract reviewed by a lawyer.  From there, you can decide the best course of action based on your options available.... You will have to have lawyer look at the agreement terms and help work through the options. If you have a personal guarantee, you may well be stuck as the obligation was yours as well as the business.

This is a very complicated BUSINESS question more so than a legal one which would focused on what CAN you do, not what TO do. As a starting point, the vast majority of such cases are NOT contingent fee cases and require retaining a lawyer at an hourly rate and retainer. If you are willing to make such a financial commitment, you need to contact a local attorney to address this immediately. How do I get a summons for a civil suit I filed?

Answered 11 years and 5 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
First, what you are doing is illegal, its called unlicensed practice of law. If there is a suit to be filed, your uncle will have to handle that matter himself or retain a lawyer to do that for it. Family members no matter how well meaning cannot do so. In addition, since you are not a lawyer, you are doing your uncle no favors by "helping him out"behind the scenes or puppetmastering the caseas you will likely make a huge mess of things and even worse actually cost him the $25,000.00 at issue if it is truly collectible.... How can I sue Out-of-State for Non-Performance?

Answered 11 years and 5 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Its simply not financially feasible to sue "get rich quick" schemes for money when they don't work. If you want to spend thousands of dollars out of pocket on legal fee to do so on principle, this would be feasible but you must expect that its just money spent making a point. You can also call your local attorney general of the FTC and see if they will take some action, but don't hold your breath. If you have any further questions please call 1-800-922-6442 for a FREE consultation.... Read More

Fraud

Answered 11 years and 5 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
First you will need more facts than that to realistically expect lawyers to respond. Second, unless you have an amazingly clear AND collectable case, you may fight very few lawyers willing to take such a case on a contingent fee. Virtually every person subjected to foreclosure screams fraud or some other misconduct having occured in the litigation foreclosure process. Sadly, while there isno doubt that ridiculous amounts of misconduct occur, proving an actual fraud case and sucessfully prosecuting one for money damages is very very very difficult and equally expensive. Most lawyers willing to work on a contingent fee view themselves as being generous in providing services and accepting payment WHEN they win and are not particularly fond of adding a great deal of IF you win to that scenario. If you REALLY think you have a fraud case worth pursuing, you may want to revisit investing in a lawyer at an hourly rate, at least for the inital phase of the case. You're entitled to get your personal items from the car. You should be able to call your local police department to see if the repo agent notified them of the repo as they are supposed to do.  Obviously, you have had some payment issues with the car lot that suggest your statement of paid on time all the time may not be quite accurate and this can be a problem claiming a wrongful repo. YOuwill simply need to retain an attorney to review this with you.  If you have any questions or concerns, please call our office at 1-800-922-6442 for a FREE consultation.... Read More

How do I retrieve my equipment

Answered 11 years and 5 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
You don't. You will have to retain a lawyer to sue the business partner for return of the items, breach of the agreement, etc. THIS is a classic example of why is it so pennywise and pound foolish not to hire a buisiness lawyer to address such transactions. You may now get stuck spending far more to try to address this issue. If you have any questions or concerns, please call our office at 1-800-922-6442 for a FREE consultation.... Read More
